3.2 The complainant asserts that his abandonment in the desert without suitable equipment by the Moroccan gendarmes was an intentional act by the State party authorities, because the gendarmes were acting with the support of their superiors and the competent political authorities.
3-2 ويعتبر صاحب البلاغ أن تخلي الدرك المغربي عنه في الصحراء دون التزوّد بما يلزم عمل متعمد من جانب السلطات المغربية إذ أن رجال الدرك تصرفوا بموافقة مسؤوليهم وبموافقة المسؤولين السياسيين المعنيين.

In the author's view, the State party has in effect rejected the Committee's Views and refers to the response on 22 September 2008 by the Minister of Justice to a question on the follow-up to this case in which she refuted the Committee's decision.
ويعتبر صاحب البلاغ أن الدولة الطرف رفضت في الواقع آراء اللجنة، مشيراً إلى رد وزيرة العدل في 22 أيلول/سبتمبر 2008 على سؤال بشأن متابعة هذه القضية حيث رفضت قرار اللجنة.

However, the author had gathered that the basis of the charge was maintaining gainful employment while collecting unemployment benefits, and it was on that basis that he and his counsel had prepared their defence.

3.5 The complainant also considers that the State party has violated article 12, read in conjunction with article 6 (para. 2) and article 7 (para. 1) of the Convention.
