The Working Group also decided to put on record a standard formula to be used, when relevant, in individual cases under the Optional Protocol regarding the issue of exhaustion of domestic remedies: " The Committee is satisfied that domestic remedies have been exhausted in the present case, for purposes of article 4, paragraph 1, of the Optional Protocol " .

5.2 With regard to the question of exhaustion of domestic remedies, the author first alleges that an application to the Supreme Court under section 17 of the Constitution, such as it is supported by the State party, would be aimed at challenging an action that is contrary to section 16 of the Constitution.
