Mr. Bazinas (Secretariat) said that, as he understood it, recommendation 106 was intended to deal with a conflict between a secured creditor that had obtained a security right under the law on secured transactions and a secured creditor that had obtained a security right under the law governing negotiable documents by negotiating the negotiable document.
