4.1 On 13 August 2012, the State party challenged the admissibility of the communication, arguing that the author had failed to exhaust all available domestic remedies.

4.1 On 23 June 2010, the State party recalled the facts of the case and challenged the admissibility of the communication, arguing that the author had failed to exhaust all available domestic remedies as he had not applied for supervisory review of the domestic courts' decisions.
4-1 في 23 حزيران/يونيه 2010، ذكَّرت الدولة الطرف بوقائع القضية وطعنت في مقبولية البلاغ، فدفعت بأن صاحب البلاغ لم يستنفد جميع سبل الانتصاف المحلية المتاحة حيث إنه لم يقدم طلباً في المراجعة القضائية لقرارات المحاكم المحلية.

4.3 On 5 October 2011, the State party challenged the admissibility of the communication, arguing that the author had failed to exhaust all available domestic remedies, as he has not requested the procurator to initiate supervisory review proceedings concerning decisions which had entered into force.

4.1 On 5 February 2009, the State party submitted that the communication should be declared inadmissible, as its allegations are incompatible with the provisions of the Convention, and the author has not exhausted all available domestic remedies.

6.2 It also reiterates that the author has failed to exhaust available domestic remedies within the supervisory review proceedings, therefore the present communication is inadmissible under article 5, paragraph 2 (b), of the Optional Protocol to the Covenant.
