وأشارت أيضاً إلى أن تعريف التعذيب واضح تماماً في أن الألم الذي يعتبر تعذيباً ينبغي أن يوقعه أو أن يحرض عليه أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية.

On the other hand, it must be noted that the notion of " with the consent or acquiescence of a public official " contained in the Convention definition is absent from the Azerbaijani definition.
ومن جهة أخرى، ينبغي ملاحظة غياب المفهوم الوارد في الاتفاقية، التي تشمله عبارة " يوافق عليه أو يسكت عنه موظف رسمي " من التعريف الأذربيجاني.

Article 1 requires that the act of torture be “committed by, or at the instigation of, or with the consent or acquiescence of a public official or any other person acting in an official capacity”.
وتنص هذه المادة على أن " يلحق " عمل التعذيب " أو يحرض عليه أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية " .

٩٤- وباﻹضافة إلى ذلك، تشمل اتفاقية اﻷمم المتحدة لمناهضة التعذيب سوء المعاملة من جانب أفراد عاديين حين يحدث " ويوافق عليه أو يسكت عنه موظف رسمي " .

Torture was defined therein as any act by which severe pain or suffering, whether physical, mental or pharmacological, was intentionally inflicted by, or at the instigation of, or with the consent or acquiescence of a public official or other person acting in an official capacity, for such purposes as obtaining information or a confession, punishment, intimidation or coercion.

132. With respect to the Convention Against Torture, it must be noted that the definition in articles 1(1) and 16 of CAT stipulates that the act must have been committed " by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity " .
132 - وفيما يتعلق باتفاقية مناهضة التعذيب، يجدر بالإشارة أن التعريف الوارد في كل من المادة 1 (1) والمادة 16 من الاتفاقية يشترط أن يرتكب الفعل ' ' أو يحرض عليه أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية`.

The Convention states: " the term `torture'means any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person ... for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity " .
حيث تنص الاتفاقية على: " يقصد " بالتعذيب " أي عمل ينتج عنه آلم أو عذاب شديد، جسدياً كان أم عقلياً، يلحق عمداً بشخص ما ... لأي سبب من الأسباب يقوم على التمييز أياً كان نوعه، عندما يُلحق مثل هذا الألم أو العذاب أو يحرض عليه أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية " .

On the first count, the State party recalls that torture, as defined by article 1 of the Convention, requires that suffering be inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.
وفيما يتعلق بالسبب الأول، تذكّر الدولة الطرف بأن التعذيب، حسب المعنى الوارد في المادة 1 من الاتفاقية، يقتضي أن يحرض على العذاب أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية(ﻫ).

4.5 As regards the alleged risk of torture by political opponents, the State party refers to the definition of " torture " of article 1 of the Convention and to the requirement that torture be " inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity " .
4-5 وفيما يتعلق بادعاء التعرض لخطر التعذيب على أيدي خصوم سياسيين، تشير الدولة الطرف إلى تعريف " التعذيب " الوارد في المادة 1 من الاتفاقية واشتراط أن يلحق مثل هذا التعذيب " أو يحرض عليه أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية " .

On the latter argument, it specifically states that the claims relating to the complainant's health condition fall outside the scope of article 3, as according to article 1 of the Convention the definition of torture relates to severe pain and suffering " inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity " .
وفيما يتعلق بالحجة الأخيرة، تذكر تحديداً أن الادعاءات المتعلقة بصحة صاحب الشكوى تخرج عن نطاق المادة 3 لأنه وفقاً للمادة 1 من الاتفاقية، يقصد بالتعذيب ألم أو عذاب شديد " يلحقه أو يحرض عليه أو يوافق عليه أو يسكت عنه موظف رسمي أو أي شخص آخر يتصرف بصفته الرسمية " .
