وجرّمت إحدى الدول الأطراف أيضاً الأشكال السلبية لإعاقة سير العدالة، بمعاقبة أي شخص يطلب أو يقبل مزية غير مشروعة أو وعد بذلك مقابل الامتناع عن ممارسة حقوقه المشروعة، أو إهمال الواجبات الرسمية في إجراءات المحكمة.
