8.9 Concerning the State party's claim that the author always had the opportunity to challenge the lawfulness of his detention, and that such a challenge was not necessarily bound to fail, counsel observes the following:

5.7 Furthermore, counsel notes that the State party has not shown that the author was not personally affected by the conviction.
٥-٧ وعلاوة على ذلك، يلاحظ المحامي أن الدولة الطرف لم تبين أن صاحب البلاغ لم يتضرر شخصيا باﻹدانة.

In this context, counsel notes that only one of the three warders refers to Mr. Burrell in his statement, saying that he was among the inmates who pushed him into the cell.

With regard to the State party's argument that the conscientious objectors received a higher pay than those performing military service, counsel notes that they worked in structures where they were treated as employees and that it was thus normal that they would receive a certain remuneration.
وفيما يتعلق بحجة الدولة الطرف بأن المستنكفين ضميرياً كانوا يحصلون على أجور أعلى من الذين يمارسون الخدمة العسكرية، يلاحظ المحامي أنهم كانوا يعملون في هياكل كانوا يعاملون فيها كموظفين ومن ثم كان من الطبيعي أن يحصلوا على أجر ما.

5.3 In further comments dated 16 August 1993, counsel notes that the lease contract for Arktinen Kivi Oy expires at the end of 1993, and that negotiations for a longer lease are underway.

8.7 On the issue of the " arbitrariness " of the author's detention, counsel notes that the State party incorrectly seeks to blame the author for the prolongation of his detention.
٨-٧ وفيما يختص بمسألة احتجاز صاحب الرسالة احتجازا " تعسفيا " ، يلاحظ المحامي أن الدولة الطرف تحاول خطأ إلقاء اللوم على صاحب الرسالة في طول مدة احتجازه.

5.5 Concerning article 13 of the Covenant, counsel notes that said provision only allows the elimination of review of an expulsion where compelling reasons of national security exist.
5-5 وفيما يتعلق بالمادة 13 من العهد، يلاحظ المحامي أن هذه المادة لا تسمح بإلغاء إعادة النظر في الأمر بالطرد إلا إذا كانت دواعي الأمن القومي تحتم ذلك.

5.7 As to Mr. Karker's sense of insecurity, counsel notes that Mr. Karker's refugee status is not permanent. But more seriously, in counsel's opinion, is the insecurity caused by the compulsory residence order, which can be changed without advance notice.

5.10 In respect of the claim under article 23 of the Covenant, counsel notes that the ECHR has constantly held that article 8 of the Convention includes a right for the parent to have measures taken with a view to his or her being reunited with the child, and an obligation for the national authorities to take such action.

أما فيما يتعلق بالقضايا السابقة التي تشير إليها الدولة الطرف كمثال على ردود المتابعة المرضية، يلاحظ المحامي أن لفظة " مُرض " يجب هنا فهمها على أنها تعني أن الأمر لا يحتاج إلى أية مراسلات إضافية، دون أن تعني بالضرورة أن اللجنة راضية بالتدابير المتخذة.

5.6 With respect to the State party's statement that the Egyptian authorities rejected the allegations made by the complainant in March 2003, counsel observes that any contrary reaction would have been surprising, and that such refutation does not disprove the complainant's allegation.
5-6 وفيما يتعلق بما ذكرته الدولة الطرف من أن السلطات المصرية قد رفضت المزاعم التي صدرت عن صاحب الشكوى في آذار/مارس 2003، يلاحظ المحامي أنه لو كان قد صدر عن تلك السلطات أي رد فعل مغاير لهذا لكان ذلك أمراً مستغرباً، وأن هذا الرفض لا يعني عدم صحة ادعاءات صاحب الشكوى.

In this context, counsel observes that in 1994, the court in Paris convicted a newspaper, Minute, for having called Mr. Karker an active terrorist, since the newspaper could not substantiate its accusations that he was involved in attacks in Monastir and in an attempt to assassinate the prime minister of Tunisia.
