In this regard, the Special Rapporteur recalls article 12 of the Convention on the Rights of Child, which provides that States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.
وتذكِّر المقررة الخاصة، في هذا الصدد، بالمادة 12 من اتفاقية حقوق الطفل التي تنص على أن تكفل الدول الأطراف في الاتفاقية للطفل القادر على تكوين آرائه الخاصة حق التعبير عن تلك الآراء بحرية في جميع المسائل التي تمس الطفل، وتولي آراء الطفل الاعتبار الواجب وفقاً لسن الطفل ونضجه.

En el párrafo 1 se garantiza a todo niño que esté en condiciones de formarse un juicio propio el derecho de expresar su opinión libremente en todos los asuntos que afectan al niño, teniéndose debidamente en cuenta las opiniones del niño, en función de la edad y madurez del niño.

15. El artículo 12 de la Convención establece el derecho de cada niño de expresar su opinión libremente en todos los asuntos que lo afectan y el subsiguiente derecho de que esas opiniones se tengan debidamente en cuenta, en función de la edad y madurez del niño.

29. Al exigir que se tengan debidamente en cuenta las opiniones, en función de la edad y la madurez, el artículo 12 deja claro que la edad en sí misma no puede determinar la trascendencia de las opiniones del niño.

21. El artículo 12 de la Convención establece el derecho de todo niño a expresar su opinión libremente en todos los asuntos que le afecten, y en consecuencia el derecho a que esas opiniones se tengan debidamente en cuenta en función de la edad y madurez del niño.

Como portadores de derechos, incluso los niños más pequeños tienen derecho a expresar sus opiniones, que deberían " tenerse debidamente en cuenta en función de la edad y madurez del niño " (art. 12.1).

Debe otorgarse la debida importancia a las opiniones de los niños, incluidos los niños con discapacidad, de acuerdo con la edad y el grado de madurez que tengan, lo cual puede suponer, entre otras cosas, oírlos en condiciones de confidencialidad y no en audiencia pública, y empleando dispositivos de vídeo/audio.
