غير أنه من الممكن مع ذلك التأسف لعدم وجود تميز واضح بين الكف عن السلوك غير المشروع وبين رد الحق نظرا ﻷن الحكم المتعلق بجبر الضرر حكم يكتسي طابعا عاما ولا يميز بين اﻷفعال غير المشروعة التي لها طابع الاستمرار وبين جميع اﻷفعال اﻷخرى.

" 1 - تلتزم الدولة التي ارتكبت فعلا غير مشروع دوليا تجاه الدولة المضرورة بتنفيذ الالتزام الذي انتهكته أو بالكف عن سلوكها غير المشروع إذا كان له طابع الاستمرار.

2- يكون خرق المنظمة الدولية لالتزام دولي بفعل لـه طابع مستمر ممتداً طوال كامل الفترة التي يستمر فيها الفعل ويظل غير مطابق للالتزام الدولي.

This is an obligation which is of a continuing character.
وهذا التزام ذو طابع مستمر.

2. The breach of an international obligation by an act of an international organization having a continuing character extends over the entire period during which the act continues and remains not in conformity with the international obligation.
2 - يمتد خرق المنظمة الدولية لالتزم دولي بعمل له طابع مستمر طوال كامل الفترة التي يستمر فيها العمل ويظل غير مطابق للالتزام الدولي.

1 - يقع خرق الدولة لالتزام دولي بفعل ليس له طابع استمراري وقت القيام بذلك الفعل، حتى لو استمرت آثاره.

" A State whose conduct constitutes an internationally wrongful act having a continuing character is under the obligation to cease that conduct, without prejudice to the responsibility it has already incurred. "
" تلتزم الدولة التي يشكل سلوكها فعلا غير مشروع دوليا له طابع الاستمرار بالكف عن هذا السلوك، وذلك دون إخلال بمسؤوليتها عن ذلك الفعل " .
