When a newly independent State establishes its status as a party or as a contracting State to a multilateral treaty, it shall be considered as maintaining any express acceptance by the predecessor State of a reservation formulated by a contracting State or contracting international organization unless it expresses a contrary intention within 12 months of the date of the notification of succession.
حين تثبت دولة مستقلة حديثا، بإشعار بالخلافة، صفتها كطرف أو كدولة متعاقدة في معاهدة متعددة الأطراف، يُعتبر أنها قد أبقت على أي قبول صريح كانت الدولة الخلف قد أبدته بشأن تحفظ لدولة متعاقدة أو منظمة دولية متعاقدة، ما لم تعرب عن نقيض هذا القصد في غضون اثني عشر شهرا بدءا من تاريخ الإشعار بالخلافة.

When an invalid reservation has been formulated in respect of one or more provisions of a treaty, or of certain specific aspects of the treaty as a whole, the treaty applies to the reserving State or to the reserving international organization, not withstanding the reservation, unless a contrary intention of the said State or organization is established.
إذا أبدي تحفظ غير صحيح على حكم أو أكثر من أحكام المعاهدة، أو على المعاهدة ككل من بعض الجوانب المعينة، تطبق المعاهدة، بالرغم من التحفظ، على الدولة أو المنظمة الدولية المتحفظة، إلا إذا ثبت أن لديها نية مخالفة لذلك.

When an invalid reservation has been formulated, the reserving State or the reserving international organization is considered a contracting State or a contracting organization or, as the case may be, a party to the treaty without the benefit of the reservation, unless a contrary intention of the said State or organization can be identified.

This presumption is reversed, however, if the successor State expresses a " contrary intention " when making the notification of succession or if, at the same time, it formulates a reservation " which relates to the same subject matter " .

The presumption is reversed not only if a " contrary intention " is specifically expressed by the successor State when making the notification of succession, but also if that State formulates a reservation " which relates to the same subject matter " as the reservation formulated by the predecessor State.

An objection to a reservation by a State which considers it to be incompatible with the object and purpose of the treaty precludes the entry into force of the treaty as between the objecting and the reserving State, unless a contrary intention shall have been expressed by the objecting State.
إن الاعتراض على تحفظ من جانب دولة تعتبره متنافياً مع موضوع المعاهدة وغرضها يحول دون بدء نفاذ المعاهدة بين الدولة المعترضة والدولة المتحفظة، ما لم تبد الدولة المعترضة نية مخالفة لذلك().

According to this guideline the author of an invalid reservation becomes a party to the treaty without the benefit of the reservation, " unless a contrary intention of the said State or organization can be identified " .

In other words, if the draft guideline was interpreted literally, a contrary intention expressed by the objecting State or organization would not be enough to prevent the entry into force of the treaty between it and the author of the reservation.
بعبارة أخرى، إذا فُسّر مشروع المبدأ التوجيهي تفسيراً حرفياً، فإن إعلان الدولة أو المنظمة المعترضة عن نية تناقض ذلك لن يكون كافياً لمنع دخول المعاهدة حيز النفاذ بينها وبين الدولة التي أبدت التحفظ.

Particularly noteworthy was the shift from the positive presumption that an author of an invalid reservation became a party to the treaty without the benefit of the reservation, unless a contrary intention of the said State could be identified, to a neutral stance whereby the intention of the reserving State determined whether it became a party to a treaty.
ومما يجدر بالذكر على وجه التحديد التحول من الافتراض الإيجابي القائل بأن صاحب التحفظ غير الصحيح يصبح طرفاً في المعاهدة دون الاستفادة من التحفظ، ما لم يتسن تبين نية مخالِفة لدى الدولة المذكورة، إلى موقف محايد بواسطته تحدد نية الدولة المتحفظة هل أصبحت هذه الدولة طرفاً في معاهدة أم لم تصبح.

54. In answer to those difficulties, the Commission had proposed a rebuttable presumption to the effect that the reservation could be severed and the reserving State should be considered a party to the treaty without the benefit of the reservation, unless a contrary intention of the reserving State could be established.
