لا يجوز اتخاذ إجراءات جبرية سابقة لصدور الحكم، مثل إجراءات الحجز، والحجز التحفظي، ضد ممتلكات دولة ما في ما يتصل بدعوى مقامة أمام محكمة دولة أخرى إلا في الحالات التالية وفي نطاقها:

The foregoing provisions shall apply to international treaties and agreements with national Governments or enterprises by virtue of which the Salvadoran State submits itself to the jurisdiction of a court of another State.
وتطبق الأحكام آنفة الذكر على المعاهدات والاتفاقات الدولية التي تبرم مع حكومات أو منشآت وطنية والتي تقبل دولة السلفادور بموجبها الخضوع لاختصاص محكمة دولة أخرى.

3 - لا يعتبر حضور ممثل دولة ما كشاهد أمام محكمة دولة أخرى موافقة من الدولة الأولى على ممارسة المحكمة لولايتها.

4. Failure on the part of a State to enter an appearance in a proceeding before a court of another State shall not be interpreted as consent by the former State to the exercise of jurisdiction by the court.
4 - لا يعتبر عدم حضور دولة ما في دعوى مقامة أمام محكمة دولة أخرى موافقة من الدولة الأولى على ممارسة المحكمة لولايتها.

No post-judgment measures of constraint, such as attachment, arrest or execution, against property of a State may be taken in connection with a proceeding before a court of another State unless and except to the extent that:
لا يجوز اتخاذ إجراءات جبرية تالية لصدور الحكم، كالحجز والحجز التحفظـي والحجز التنفيذي، ضد ممتلكات دولة مـا في ما يتصل بدعوى مقامة أمام محكمة دولة أخرى إلا في الحالات التالية وفي نطاقها:

The present Convention shall, however, continue to apply to any question of jurisdictional immunities of States or their property arising in a proceeding instituted against a State before a court of another State prior to the date on which the denunciation takes effect for any of the States concerned.
غير أن هذه الاتفاقية تظل سارية على أي مسألة متعلقة بحصانات الدول أو ممتلكاتها من الولاية القضائية تثار في دعوى مقامة ضد إحدى الدول أمام محكمة دولة أخرى قبل التاريخ الذي يدخل فيه نقض هذه الاتفاقية حيز النفاذ تجاه أي دولة من الدول المعنية.

لا يجوز اتخاذ إجراءات جبرية تالية لصدور الحكم، كالحجز والحجز التحفظـي والتنفيذي، ضد ممتلكات دولة مـا في ما يتصل بدعوى مقامة أمام محكمة دولة أخرى إلا في الحالات التالية وفي نطاقها:

1. The Courts of the State in which an arrest has been effected or security provided to obtain the release of the ship shall have jurisdiction to determine the case upon its merits, unless the parties validly agree or have validly agreed to submit the dispute to a court of another State which accepts jurisdiction, or to arbitration.
1- تختص المحاكم في الدولة التي يوقع فيها الحجز أو يقدم فيها الضمان لرفع الحجز عن السفينة بالبت في موضوع الدعوى، ما لم تتفق الأطراف اتفاقاً سليماً أو تكون قد اتفقت اتفاقاً سليماً على عرض النزاع على التحكيم أو على محكمة تابعة لدولة أخرى تقبل ذلك الاختصاص.
