1. A person shall not be criminally responsible under this Statute unless the conduct in question constitutes, at the time it takes place, a crime within the jurisdiction of the Court.
1 - لا يُسأل الشخص جنائيا بموجب هذا النظام الأساسي ما لم يشكل السلوك المعني، وقت وقوعه، جريمة تدخل في اختصاص المحكمة.

2. A person who commits a crime within the jurisdiction of the Court shall be individually responsible and liable for punishment in accordance with this Statute.
2 - الشخص الذي يرتكب جريمة تدخل في اختصاص المحكمة يكون مسؤولا عنها بصفته الفردية وعرضة للعقاب وفقا لهذا النظام الأساسي.

(i) Be made with the aim of furthering the criminal activity or criminal purpose of the group, where such activity or purpose involves the commission of a crime within the jurisdiction of the Court; or

(a) the suspect has committed a crime within the jurisdiction of the Court; and
)أ( المشتبه فيه ارتكب جريمة تدخل ضمن اختصاص المحكمة؛ وبأن

" Victims " means persons who, individually or collectively, have suffered harm, including physical or mental injury, emotional suffering, economic loss or substantial impairment of their fundamental rights, through conduct that constitutes a crime within the jurisdiction of the Court.
يقصد بـ " المجني عليهم " الأشخاص الذين أصيبوا بضرر، فرديا أو جماعيا، بما في ذلك الضرر البدني أو العقلي أو المعاناة النفسية أو الخسارة الاقتصادية أو الحرمان بدرجة كبيرة من التمتع بحقوقهم الأساسية عن طريق أفعال تشكل جريمة تدخل في نطاق اختصاص المحكمة.

(a) The right to be informed that there are grounds to believe that he or she has committed a crime within the jurisdiction of the Special Tribunal;

As stated in article 30, unless otherwise provided, a person shall be criminally responsible and liable for punishment for a crime within the jurisdiction of the Court only if the material elements are committed with intent and knowledge.
وكما هو مبين في المادة 30، ما لم ينص على غير ذلك، لا يسأل الشخص جنائيا عن ارتكاب جريمة تدخل في اختصاص المحكمة ولا يكون عرضة للعقاب على هذه الجريمة إلا إذا تحققت الأركان المادية مع توافر القصد والعلم.

[a suspect has committed a crime within the jurisdiction of the Court]

(a) there is probable cause to believe that the suspect may have committed a crime within the jurisdiction of the Court; and
)أ( وجد سبب يرجح معه الاعتقاد بأن من الممكن أن يكون المشتبه فيه قد ارتكب جريمة تدخل في اختصاص المحكمة؛

(ii) a statement of the reasons to believe the suspect may have committed a crime within the jurisdiction of the Court and that the Prosecutor expects to seek an indictment within [90] days;
' ٢` بيان باﻷسباب التي تحمل على الاعتقاد بأن المشتبه فيه يمكن أن يكون قد ارتكب جريمة تدخل في اختصاص المحكمة وأن المدعي العام يتوقع أن يطلب توجيه الاتهام في غضون ]٩٠[ يوما؛

3. In accordance with this Statute, a person shall be criminally responsible and liable for punishment for a crime within the jurisdiction of the Court if that person:

1. Unless otherwise provided, a person shall be criminally responsible and liable for punishment for a crime within the jurisdiction of the Court only if the material elements are committed with intent and knowledge.
1 - ما لم ينص على غير ذلك، لا يُسأل الشخص جنائيا عن ارتكاب جريمة تدخل في اختصاص المحكمة ولا يكون عرضة للعقاب على هذه الجريمة إلا إذا تحققت الأركان المادية مع توافر القصد والعلم.

2. A mistake of law as to whether a particular type of conduct is a crime within the jurisdiction of the Court shall not be a ground for excluding criminal responsibility.
2 - لا يشكل الغلط في القانون من حيث ما إذا كان نوع معين من أنواع السلوك يشكل جريمة تدخل في اختصاص المحكمة سببا لامتناع المسؤولية الجنائية.

(a) To be informed, prior to being questioned, that there are grounds to believe that he or she has committed a crime within the jurisdiction of the Court;
(أ) أن يجري إبلاغه، قبل الشروع في استجوابه، بأن هناك أسبابا تدعو للاعتقاد بأنه ارتكب جريمة تدخل في اختصاص المحكمة؛

(a) There are reasonable grounds to believe that the person has committed a crime within the jurisdiction of the Court; and
(أ) وجـود أسبـاب معقولـة للاعتقـاد بأن الشخص قد ارتكب جريمة تدخل في اختصاص المحكمة؛ و

The use of weapons of mass destruction with indiscriminate effects on combatants and non-combatants, should also constitute a crime within the jurisdiction of the Court.
وينبغي لاستخدام اﻷسلحة ذات الدمار الشامل التي لها آثار عشوائية على المتحاربين وغير المتحاربين ينبغي أن تشكل جريمة تدخل في اختصاص المحكمة .

(a) Ordering, soliciting, inciting, instigating or attempting the commission of a crime within the jurisdiction of the Court that has not in fact occurred;
)أ( اﻷمر بارتكاب جريمة تدخل في اختصاص المحكمة أو اقتراح ارتكابها أو الحث أو التحريض عليها أو محاولة ارتكابها، دون أن ترتكب؛

[(v) [continue to commit a crime within the jurisdiction of the Court.] Some delegations favoured addressing situations in which the accused may be harmed or at risk.

(a) The Prosecutor shall transmit the warrant to the State where the suspect is located, along with a request for the arrest of the suspect and a statement of the reasons to believe that the suspect may have committed a crime within the jurisdiction of the Court and that the Prosecutor expects to file an indictment and make a request for indictment within [90] days.
)أ( يحيل المدعي العام أمر القبض إلى الدولة التي يوجد فيها المشتبه فيه، مشفوعا بطلب للقبض عليه وبيان باﻷسباب التي تدعو إلى الاعتقاد بأن من الممكن أن يكون المشتبه فيه قد ارتكب جريمة تدخل في نطاق اختصاص المحكمة وبأن المدعي العام يتوقع أن يصدر لائحة الاتهام وأن يطلب توجيه الاتهام في غضون ]٩٠[ يوما.
