2. Any official who neglects or fails to promptly notify the competent authority of a felony or misdemeanour that comes to his knowledge during or in the course of his discharge of his duty shall be liable to the fine specified above.
2- كل موظف أهمل أو أرجأ إعلام السلطة ذات السلطة ذات الصلاحية عن جناية أو جنحة عرف بها أثناء قيامه بالوظيفة أو في معرض قيامه بها عوقب بالغرامة المحددة أعلاه.

260. A judge may issue an arrest warrant only if he is convinced that there is a reasonable suspicion that the person committed a felony or misdemeanour, and that one of the following grounds applies:
القبض بناء على أمر 260- يجوز للقاضي أن يصدر أمراً بالقبض متى اقتنع بأن هناك شكوكا مقبولة في أن الشخص ارتكب جناية أو جنحة وذلك وفقاً لما يلي:

II. Anyone who acquires a thing obtained through a felony or misdemeanour under conditions leading him to believe that the source thereof is unlawful shall be punished by imprisonment for a period of not less than three years.
ثانيا - يعاقب بالحبس مدة لا تقل عن ثلاث سنوات من حاز على شيء متحصل من جناية أو جنحة وكان ذلك في ظروف تحمله على الاعتقاد بعدم مشروعية مصدره.

Article 12 provides that the same Law applies to any person in the employ of Iraq or entrusted with a public service of or for Iraq who commits, while abroad, during the performance or because of his work, a felony or misdemeanour provided for in the said Law.
نصَّت المادة على أن " يسري هذا القانون على كل من ارتكب في الخارج من موظفي العراق أو المكلفين بخدمة عامة لها أثناء تأدية أعمالهم أو بسببها جناية أو جنحة مما نُص عليه في هذا القانون.

" Every official agency or employee who in the course of his duties becomes aware of the commission of a felony or misdemeanour shall report the matter immediately to the competent Public Prosecutor, providing all available information and documentation relating to the offence. "

Any Iraqi citizen who commits an act abroad and does so as principal or accessory to an offence that is considered a felony or misdemeanour under the Criminal Code is punishable in accordance with its provisions if the person is in Iraq and the offence is punishable under the laws of the land in which it is committed.
يخضع أي مواطن عراقي يرتكب فعلاً في الخارج وقام بذلك الفعل كطرف أصيل أو مساعد في جريمة تعتبر جناية أو جنحة بموجب قانون العقوبات ووفقاً لأحكامه للعقوبة إذا كان الشخص موجوداً في العراق ويخضع ذلك الشخص للعقوبة وفقاً لقوانين الدولة التي ارتكب الجريمة عليها.

204. Juveniles charged with a felony or misdemeanour have a priority right to appoint a person to defend them. If the juvenile stands accused of a felony and neither he nor his guardian has appointed a lawyer to defend him, the court must designate a lawyer to undertake that task.
٤٠٢- كما أن للحدث المتهم في جناية أو جنحة أو لوليه الحق في أن يوكل من يدافع عنه وإذا كان الحدث متهماً بارتكاب جناية ولم يوكل هو أو وليه محامياً للدفاع عنه وجب على المحكمة أن تنتدب من المحامين من يقوم بهذه المهمة أما إذا كان متهماً بارتكاب جنحة فيكون ندب محام للدفاع عنه جوازياً للمحكمة.
