٤٠٨ - وتوصي اللجنة بأن تتخذ الحكومة المزيد من التدابير لتنفيذ أحكام المادة ٤ من الاتفاقية تنفيذا كاملا، وهي أحكام ذات طابع إلزامي مثلما تنص على ذلك التوصية العامة السابعة )٣٢( للجنة، وتلك التوصية التي تلزم الدول اﻷطراف بإعلان لا قانونية المنظمات التي تشجع التمييز العنصري وحظرها.

391. The Committee reaffirms that the provisions of article 4, paragraphs (a) and (b), of the Convention are of a mandatory character as stated in general recommendation XV (32) of the Committee and recommends that the State party implement each of the obligations.
٣٩١ - واللجنة تؤكد من جديد أن اﻷحكام الواردة في الفقرتين )أ( و )ب( من المادة ٤ من الاتفاقية لها طابع إلزامي وفقا لما هو مذكور في التوصية العامة الخامسة عشرة )٣٢( الصادرة عن اللجنة، وهي توصي الدولة الطرف بتنفيذ كل التزام من تلك الالتزامات.

The Committee accordingly regrets that the State party continues to maintain its restrictive interpretation of the provisions of article 4 of the Convention which the Committee has determined as being of a mandatory character in its general recommendation No. 15 (1993) on article 4 of the Convention, which, inter alia, deals with organized violence based on ethnic origin (arts. 2, 4 and 6).
وبناء عليه تأسف اللجنة لمواصلة الدولة الطرف تفسيرها التقييدي لأحكام المادة 4 من الاتفاقية التي ارتأت أنها ذات طابع إلزامي حسبما جاء في توصيتها العامة رقم 15(1993) بشأن المادة 4 من الاتفاقية، وهي التوصية التي تتناول أموراً منها العنف المنظم القائم على الأصل الإثني (المواد 2 و4 و6).

It recalls that such interpretation is in conflict with the State party's obligations under article 4 (b) of the Convention and draws the State party's attention to the Committee's general recommendation XV according to which the provisions of article 4 are of a mandatory character
وتذكرها بأن هذا التفسير يتعارض والتزامات الدولة الطرف القائمة بموجب الفقرة (ب) من المادة 4 من الاتفاقية، كما تلفت انتباه الدولة الطرف إلى التوصية العامة الخامسة عشرة التي تعتبر أن أحكام المادة 4 هي أحكام ذات طابع إلزامي.
