Notwithstanding article 81 and without prejudice to article 82, the contract of carriage may exclude or limit the obligations or the liability of both the carrier and a maritime performing party if:

An inland carrier is a maritime performing party only if it performs or undertakes to perform its services exclusively within a port area.
ولا يعتبر الناقل الداخلي طرفا منفِّذا بحريا إلاّ إذا كان يؤدّي، أو يتعهّد بأن يؤدّي خدماته حصرا داخل منطقة ميناء.

4. Nothing in this Convention imposes liability on the master or crew of the ship or on an employee of the carrier or of a maritime performing party.
٤ - ليس في هذه الاتفاقية ما يلقي المسؤولية على عاتق ربان السفينة أو طاقمها أو على عاتق أحد مستخدمي الناقل أو الطرف المنفذ البحري.

1. a maritime performing party is subject to the obligations and liabilities imposed on the carrier under this Convention and is entitled to the carrier's defences and limits of liability as provided for in this Convention if:
1 - يتحمل الطرف المنفذ البحري الواجبات والمسؤوليات الملقاة على عاتق الناقل بمقتضى هذه الاتفاقية، ويحق لـه التمتع بالدفوع وحدود المسؤولية المتاحة للناقل حسبما تنص عليه هذه الاتفاقية إذا:

When pursuant to applicable law a deviation constitutes a breach of the carrier's obligations, such deviation of itself shall not deprive the carrier or a maritime performing party of any defence or limitation of this Convention, except to the extent provided in article 61.
عندما يقضي القانون المنطبق بأن الانحراف عن المسار يشكل إخلالا بواجبات الناقل، لا يحرم هذا الانحراف عن المسار في حد ذاته الناقل أو الطرف المنفذ البحري من أي وسيلة دفاع أو حد من المسؤولية بمقتضى هذه الاتفاقية، باستثناء ما هو منصوص عليه في المادة ٦1.

It was thought that the first sentence of paragraph 1 was uncontroversial since it was logical that if a claimant wished to sue a contracting carrier and a maritime performing party in a single action, that it would be required to do so in a court that had jurisdiction for both actions.
ورئي أنّ الجملة الأولى من الفقرة 1 ليست مثار جدل لأن المنطق يقتضي من المطالِب الذي يرغب في مقاضاة الناقل المتعاقد والطرف المنفّذ البحري في دعوى واحدة أن يقوم بذلك في محكمة لها اختصاص النظر في الدعوى على كليهما.

Furthermore, there might be doubts as to whether a road or rail carrier that brought goods into the port area would qualify as a maritime performing party for its entire journey or whether it would be a mere performing party until it reached the port area and would become a maritime performing party upon entering the port area.
