Clauses allowing the lenders to select, with the consent of the contracting authority, a new concessionaire to perform under the existing project agreement have been included in a number of recent agreements for large infrastructure projects.

For that purpose, it may be useful for the law to require the concessionaire to make the assets available to a new concessionaire.

(b) That the contracting authority may enter into agreements with the lenders allowing them to appoint a new concessionaire to perform under the existing project agreement if the concessionaire seriously fails to deliver the service required under the project agreement or if other specified events occur that could justify the termination of the project agreement. In this case, upon expiry of the project agreement the contracting authority is normally required to begin a new selection process to select a new concessionaire, normally using the same procedures applied to select the concessionaire whose concession has expired (see chap. III, “Selection of the concessionaire”, ___).
