4-6 وفيما يتعلق بادعاء صاحب الشكوى أنه لو عاد إلى بنغلاديش سيتعرض لخطر لإساءة المعاملة على أيدي خصومه السياسيين، ترى الدولة الطرف أن خطر التعرض لإساءة المعاملة على أيدي كيان غير حكومي أو أفراد عاديين بدون موافقة أو رضا حكومة البلد المستقبِل، لا يدخل في نطاق المادة 3 من الاتفاقية.

The Committee notes that the issue of whether a State party has an obligation to refrain from expelling a person who might risk torture or ill-treatment inflicted by a non-governmental entity falls within the scope of article 3 of the Convention in cases in which there is consent or acquiescence of the State's authorities in the country of return to such conduct.
