٦ - إذا انطبقت قاعدة قانونية اجباريا على عقد لنقل البضائع يتضمنه مستند ورقي أو يثبته مستند ورقي، لا يجوز عدم تطبيق تلك القاعدة على هذا العقد لنقل البضائع الذي تثبته رسالة بيانات واحدة أو أكثر لمجرد أن العقد تثبته رسالة أو رسائل البيانات هذه بدلا من أن يثبته مستند ورقي.

145. According to paragraph (2), this provision applies whether the requirement for a written document is in the form of an obligation or whether the law provides certain consequences for failing to conduct the action in writing or to use a paper document.
٥٤١- ووفقا للفقرة )٢(، ينطبق هذا الحكم سواء كان شرط استخدام المستند الخطي في شكل التزام أو كان القانون ينص على عواقب معينة تترتب على عدم تنفيذ الفعل خطيا أو على عدم استخدام مستند ورقي.

" (6) If a rule of law is compulsorily applicable to a contract of carriage of goods which is in, or is evidenced by, a paper document, that rule shall not be rendered inapplicable to a contract of carriage of goods which is evidenced by one or more data message by reason of the fact that the contract is evidenced by such data message or messages instead of by a paper document.

" (3) Where one or more data messages have been used to effect any of the actions in paragraph (1) (f) or (g) of this article, and a paper document is subsequently to be used to effect any such action, no such paper document is effective for the purpose of any rule of law mentioned in paragraph (4) of this article, unless:

169. It was questioned whether the result intended by paragraph (6) was not already achieved by paragraph (2), which provided that, where a law required that any of the actions listed in paragraph (1) had to be carried out in writing or by using a paper document, that requirement was satisfied if the action was carried out by using one or more data messages.
