١١ - وفي ضوء ما تقدم، ترى اللجنة أن الدولة الطرف ملزمة، في الظروف الراهنة، بالامتناع عن إعادة السيد كافح ياراغ طالا بالقوة إلى إيران، أو إلى أي بلد آخر يواجه فيه خطرا حقيقيا بطرده أو إعادته إلى إيران.

In the light of the above, the Committee is of the view that, in the prevailing circumstances, the State party has an obligation, in accordance with article 3 of the Convention, to refrain from forcibly returning the author to Tunisia or to any other country where he runs a real risk of being expelled or returned to Tunisia.
٧ - وعلى ضوء ما سبـق، تــرى اللجنة أنه، نظرا للظروف السائدة، فإن الدولة الطرف ملزمة وفقا للمادة ٣ من الاتفاقية بالامتناع عن إعادة مقدم البلاغ قسريا إلى تونس أو إلى أي بلد آخر يواجه فيه خطرا حقيقيا بطرده أو إعادته إلى تونس.
