4. Article 6 of the Agreement between the United Nations and the Government of Sierra Leone on the Establishment of a Special Court for Sierra Leone stipulates that, should voluntary contributions be insufficient for the Court to implement its mandate, the Secretary-General and the Security Council shall explore alternate means of financing the Special Court.

The Special Court for Sierra Leone ( " Special Court " ) began its operations in July 2002 following the signing on 16 January 2002 of the Agreement between the United Nations and the Government of Sierra Leone on the Establishment of a Special Court for Sierra Leone ( " Agreement " ).

71. It has been the understanding of the Security Council and the Secretariat that the implementation of the Agreement on the Establishment of a Special Court for Sierra Leone would commence only after it could be ascertained that sufficient contributions were in hand to finance the establishment of the Court and 12 months of its operation, and pledges equal to the anticipated expenses for the following 24 months.

On 16 January 2002, the Government of Sierra Leone and the United Nations signed the Agreement on the Establishment of a Special Court for Sierra Leone and the Statute annexed thereto (S/2000/915, annex).

After reaching an agreement in principle on the draft Agreement on the Establishment of a Special Court for Sierra Leone and the statute annexed thereto (S/2000/915, annex), the Government of Sierra Leone sought to revert to the question of the temporal jurisdiction of the Court with a view to extending it back to 1991.

Following the submission of the report by the Secretary-General on the establishment of a Special Court for Sierra Leone (S/2000/915), letters were exchanged between the Security Council and the Secretary-General which led to modifications in the texts of both the draft Agreement with the Government of Sierra Leone and the draft statute of the Court (S/2000/1234, S/2001/40 and S/2001/95).

Further progress has been made in preparations for the establishment of the Special Court following the signing on 16 January 2002 of the Agreement between the United Nations and the Government of Sierra Leone on the Establishment of a Special Court for Sierra Leone and the statute enclosed therewith (S/2000/915, annex).
55 - وقد حصل مزيد من التقدم في الاستعدادات الجارية لإنشاء المحكمة الخاصة بعد أن تم في 16 كانون الثاني/يناير 2002 توقيع الاتفاق بين الأمم المتحدة وحكومة سيراليون بشأن إنشاء المحكمة الخاصة لسيراليون والنظام الأساسي الملحق به (S/2000/915، المرفق).

The Agreement between the United Nations and the Government of Sierra Leone on the Establishment of a Special Court for Sierra Leone (see appendix II) was signed on 16 January 2002 by Hans Corell and the Attorney General and Minister of Justice of Sierra Leone, Solomon E. Berewa, in the presence of the President of Sierra Leone, Ahmad Tejan Kabbah.
