4. A procuring entity that decides to limit the participation of suppliers or contractors in procurement proceedings pursuant to this article shall include in the record of the procurement proceedings a statement of the reasons and circumstances on which it relied.
4- تُدرج الجهةُ المشترية التي تقرِّر الحدَّ من مشاركة الموَرِّدين أو المقاولين في إجراءات الاشتراء عملاً بهذه المادة في سجل إجراءات الاشتراء بياناً بالأسباب والظروف التي استندت إليها في ذلك.

2. The procuring entity shall include in the record required under article 25 of this Law a statement of the reasons and circumstances upon which it relied to justify the use of a framework agreement procedure and the type of framework agreement selected.
2- تُدرج الجهة المشترية في السجل المطلوب بمقتضى المادة 25 من هذا القانون بياناً بالأسباب والظروف التي استندت إليها في تسويغ اللجوء إلى إجراءات الاتفاق الإطاري ونوع الاتفاق الإطاري الذي اختارته.

3. The procuring entity shall include in the record required under article 25 of this Law a statement of the reasons and circumstances upon which it relied to justify the use of direct solicitation in request-for-proposals proceedings.
3- تُدرِج الجهة المشترية في السجل المطلوب بمقتضى المادة 25 من هذا القانون بياناً بالأسباب والظروف التي استندت إليها لتسويغ اللجوء إلى الالتماس المباشر في إجراءات طلب الاقتراحات.

(c) a statement of the reasons and circumstances relied upon by the procuring entity for the decision as regards means of communication and any requirement of form;
(ج) بيانا بالأسباب والظروف التي استندت إليها الجهة المشترية في اتخاذ قرارها بشأن وسيلة الاتصال وأي اشتراط يتعلق بالشكل؛

(d) In the procurement proceedings in which the procuring entity, in accordance with article 8 of this Law, limits participation of suppliers or contractors, a statement of the reasons and circumstances relied upon by the procuring entity for imposing the limitation;
(د) في إجراءات الاشتراء التي تحدّ فيها الجهة المشترية، وفقا للمادة 8 من هذا القانون، من مشاركة المورِّدين أو المقاولين، بيانا بالأسباب والظروف التي استندت إليها الجهة المشترية في فرض ذلك الحد؛

(k) Guatemala's failure to require Cementos Progreso to provide a statement of the reasons why summarization of the information submitted during verification was not possible is inconsistent with Article 6.5.1 of the ADA.

The proposing Party shall provide a statement of the reasons for concern including, where possible, a comparison of toxicity or ecotoxicity data with detected or predicted levels of a chemical resulting or anticipated from its long-range environmental transport, and a short statement indicating the need for global control;
(أ) يقدم الطرف المقترح بياناً بالأسباب الداعية للقلق، بما فيها، إن أمكن، مقارنة لبيانات السمية أو السمية الإيكولوجية، مع المستويات المكتشفة أو المتنبأ بها للمادة الكيميائية، الناتجة عن أو المتوقعة من الانتقال البيئي البعيد المدى، وبياناً قصيراً يبين الحاجة إلى الرقابة على مستوى عالمي؛

(c) a statement of the reasons and circumstances relied upon by the procuring entity for the decision as regards means of communication and any requirement of form;

(d) In procurement proceedings in which the procuring entity, in accordance with article 8 of this Law, limits the participation of suppliers or contractors, a statement of the reasons and circumstances relied upon by the procuring entity for imposing such a limit;
(د) في إجراءات الاشتراء التي تحدّ فيها الجهة المشترية، وفقاً للمادة 8 من هذا القانون، من مشاركة المورِّدين أو المقاولين، بياناً بالأسباب والظروف التي استندت إليها الجهة المشترية في فرض ذلك الحد؛

(e) If the procuring entity uses a method of procurement other than open tendering, a statement of the reasons and circumstances relied upon by the procuring entity to justify the use of such other method;
(ﻫ) في حال استخدام الجهة المشترية طريقة اشتراء أخرى غير المناقصة المفتوحة، بياناً بالأسباب والظروف التي استندت إليها الجهة المشترية لتسويغ استخدام تلك الطريقة الأخرى؛

(g) In the case of a framework agreement procedure, a statement of the reasons and circumstances upon which it relied to justify the use of a framework agreement procedure and the type of framework agreement selected;
(ز) في حالة إجراءات الاتفاق الإطاري، بياناً بالأسباب والظروف التي استندت إليها الجهة المشترية لتسويغ استخدام إجراءات الاتفاق الإطاري ونوع الاتفاق الإطاري المختار؛

(j) If no standstill period was applied, a statement of the reasons and circumstances relied upon by the procuring entity in deciding not to apply a standstill period;
(ي) في حال عدم تطبيق فترة توقف، بياناً بالأسباب والظروف التي استندت إليها الجهة المشترية في اتخاذ قرارها بعدم تطبيق فترة توقف؛

3. If the procuring entity uses a method of procurement other than open tendering, it shall include in the record required under article 25 of this Law a statement of the reasons and circumstances upon which it relied to justify the use of that method.
3- إذا استخدمت الجهة المشترية طريقة اشتراء أخرى غير المناقصة المفتوحة، فعليها أن تُدرج في السجل المطلوب بمقتضى المادة 25 من هذا القانون بياناً بالأسباب والظروف التي استندت إليها في تسويغ استخدام تلك الطريقة.

(b) The procuring entity includes in the record required under article 25 of this Law a statement of the reasons and circumstances on which it relied to justify the conclusion of separate agreements; and
(ب) إذا أدرجت الجهةُ المشترية في السجل المطلوب بمقتضى المادة 25 من هذا القانون بياناً بالأسباب والظروف التي استندت إليها لتسويغ إبرام اتفاقات منفصلة؛

(e) If the procuring entity uses a method of procurement other than open tendering, a statement of the reasons and circumstances relied upon by the procuring entity to justify the use of such other method;
(ﻫ) في حال استخدام الجهة المشترية طريقة اشتراء أخرى غير المناقصة المفتوحة، بيانا بالأسباب والظروف التي استندت إليها الجهة المشترية لتسويغ استخدام تلك الطريقة الأخرى؛

(j) If no standstill period was applied, a statement of the reasons and circumstances relied upon by the procuring entity in deciding not to apply a standstill period;
(ي) في حال عدم تطبيق فترة توقف، بيانا بالأسباب والظروف التي استندت إليها الجهة المشترية في اتخاذ قرارها بعدم تطبيق فترة توقف؛

(3) The procuring entity shall include in the record required under article 24 of this Law a statement of the reasons and circumstances upon which it relied to justify the use of direct solicitation in request for proposals proceedings.
(3) تُدرِج الجهة المشترية في السجل المطلوب بمقتضى المادة 24 من هذا القانون بيانا بالأسباب والظروف التي استندت إليها لتسويغ اللجوء إلى الالتماس المباشر في إجراءات طلب الاقتراحات.

The use of any other procurement method still requires justification through a consideration of whether the conditions for use under articles 29 to 31 of the 2011 text are satisfied; a statement of the reasons and circumstances relied upon by the procuring entity to justify the use of such other method is still to be included in the record of the procurement proceedings.
وما زال استخدام أيِّ طريقة اشتراء أخرى يحتاج إلى مبررات بالتحقق ممّا إذا كانت شروط الاستخدام بموجب المواد من 29 إلى 31 في نصّ عام 2011 مستوفاة؛ وما زال من المطلوب أن يُدرج في سجل إجراءات الاشتراء بيان بالأسباب والظروف التي استندت إليها الجهة المشترية لتسويغ استخدام تلك الطريقة الأخرى.

If changes to the composition of the preselected bidders are subsequently permitted, a statement of the reasons for authorizing such changes and a finding as to the qualifications of the new members or members admitted to the consortia concerned;
)ج( اذا سمح في وقت لاحق باجراء تغييرات في تشكيل مقدمي العروض الذين وقع عليه الاختيار اﻷولي ، تعين تقديم بيان باﻷسباب الدافعة الى اعطاء الاذن باجراء هذه التغييرات وتقديم كشف بشأن مؤهلات اﻷعضاء الجدد أو اﻷعضاء المقبولين في الكونسورتيومات المعنية ؛

a statement of the reasons for the Tribunal's decision shall accompany each such order.
ويرفق بكل أمر من هذا القبيل بيان بأسباب قرار المحكمة.
