Article 43 contains a clear prohibition against negotiations between the procuring entity and a supplier or contractor concerning a tender submitted by the supplier or contractor.
تتضمّن المادة 43 حظراً واضحاً بشأن المفاوضات بين الجهة المشترية وأيِّ مورِّد أو مقاول بخصوص عطاء قدَّمه المورِّد أو المقاول.

(1) (أ) يجوز للجهة المشترية أن تطلب من المورّد أو المقاول إيضاحات بشأن عطائه لكي تساعدها على فحص العطاءات وتقييمها؛

34- وأُوضح أنه لا يقصد من الاقتراحين المساس بحق الجهة المشترية في رفض العطاء بمقتضى مواد أخرى من القانون النموذجي أو إسقاط أهلية مورّد أو مقاول بمقتضى المادتين 6 و7 من القانون النموذجي.

وإن الأسس التي يُستند إليها لاستبعاد مورِّد أو مقاول من إجراءات الاشتراء لأسباب غير متصلة بالمؤهلات أو بمحتوى العرض المقدَّم قد تخضع لتغييرات مع مرور الزمن ويتعذر تقديم قائمة شاملة.

وعلى الجهة المشترية أن تردَّ على أيِّ طلب استيضاح لوثائق الالتماس تتلقاه من الموَرِّد أو المقاول وذلك في غضون وقت معقول قبل الموعد النهائي لتقديم العروض.

(b) A procuring entity may disqualify a supplier or contractor if it finds at any time that the information submitted concerning the qualifications of the supplier or contractor was materially inaccurate or materially incomplete;
