2. Paragraph 1 is to be interpreted as including reservations which purport to exclude or to modify the legal effect of certain provisions of a treaty, or of the treaty as a whole with respect to certain specific aspects, in their application to the State or to the international organization which formulates the reservation.
2 - ينبغي أن تفسر الفقرة 1 على أنها تشمل التحفظات التي ترمي إلى استبعاد أو تعديل الأثر القانوني لأحكام معينة من المعاهدة أو للمعاهدة ككل فيما يتعلق ببعض الجوانب المحددة عند تطبيق هذه الأحكام على الدولة أو المنظمة الدولية التي تصوغ التحفظ.

(7) It may be deduced from the foregoing that an interpretative declaration may in no way modify " the legal effect of certain provisions of a treaty or of the treaty as a whole with respect to certain specific aspects " .
7) ويمكن الاستنتاج انطلاقاً من هذه العناصر أن الإعلان التفسيري لا يمكن أن يعدِّل " الأثر القانوني لأحكام معينة من المعاهدة أو للمعاهدة ككل فيما يتعلق ببعض الجوانب المحددة " ().

A reservation " established " within the meaning of guideline 4.1 produces all the effects purported by its author, that is to say, to echo the wording of guideline 1.1.1 (Object of reservations), " to exclude or modify the legal effect of certain provisions of a treaty or of the treaty as a whole with respect to certain specific aspects " .

Interpretative declarations " purport to specify or clarify the meaning or scope attributed by the declarant to a treaty or to certain of its provisions " , whereas reservations purport " to exclude or to modify the legal effect of certain provisions of a treaty or of the treaty as a whole with respect to certain specific aspects " .
فالإعلانات التفسيرية " تهدف [...] إلى تحديد أو إيضاح المعنى أو النطاق الذي تسنده الجهة المصدرة للإعلان إلى المعاهدة أو إلى بعض أحكامها " بينما التحفظات تهدف " إلى استبعاد أو تعديل الأثر القانوني لأحكام معينة من المعاهدة أو للمعاهدة ككل فيما يتعلق ببعض الجوانب المحددة " .

Mr. Joyini (South Africa) said that his delegation welcomed the provisional adoption of the Guide to Practice and concurred with the Commission that a reservation established within the meaning of guideline 4.1 produced all the effects purported by its author: in other words, it excluded or modified the legal effect of certain provisions of a treaty or of the treaty as a whole with respect to certain specific aspects.
