10- تعرب اللجنة عن قلقها إزاء انعدام الشكاوى والملاحقات القضائية والإدانات المتعلقة بالجرائم المرتكبة بدافع الانتماء الإثني أو العرقي المرفوعة إلى المحاكم أو إلى لجنة حقوق الإنسان في فيجي بالرغم من وجود حالات إبلاغ في البلد عن التمييز المؤسسي أو بالأحرى التمييز العنصري، بما فيها الحالات المبلغ عنها من قبل المكلفين بإنفاذ القانون.

It reminds it that the Absence of complaints and court cases on the part of victims of racial discrimination may reflect the non-existence of specific relevant legislation, ignorance of available remedies, fear of social disapproval or the unwillingness of the responsible authorities to institute legal proceedings.
وتذكّر اللجنة الدولة الطرف بأن غياب الشكاوى والدعاوى القضائية من جانب ضحايا التمييز العنصري قد يكشف عدم وجود تشريع محدد ذي صلة بالموضوع، ويكشف الجهل بسبل الانتصاف المتاحة أو الخوف من نبذ المجتمع أو انعدام الإرادة لدى السلطات المكلفة برفع الدعاوى.

It observes that the Absence of complaints does not equate with an absence of discrimination but may instead be a reflection of a lack of trust in the judicial system and law enforcement authorities or a lack of knowledge on the part of the most vulnerable sectors of the population about the legal remedies available (art. 6).
وتلاحظ اللجنة أن غياب الشكاوى لا يعني عدم وقوع التمييز، وإنما قد يعكس انعدام ثقة في النظام القضائي وفي سلطات إنفاذ القانون أو جهل الشرائح السكانية الأكثر تعرضاً للتمييز بسبل التظلم القانوني المتاحة (المادة 6).

In 2003, CERD reminded Tunisia that the mere Absence of complaints and legal action by victims of racial discrimination may be mainly an indication of the absence of relevant specific legislation, or of a lack of awareness of the availability of legal remedies, or of insufficient will on the part of the authorities to prosecute.

19. While noting that the High Committee on Human Rights and Fundamental Freedoms has received over 4,100 complaints of violations of rights since the last concluding observations, the Committee notes the information provided by the delegation on the Absence of complaints of racial discrimination.
19- واللجنة إذ تلاحظ أن الهيئة العليا لحقوق الإنسان والحريات الأساسية قد تلقت أكثر من 100 4 شكوى تتعلق بانتهاكات لحقوق الإنسان منذ صدور آخر تعليقات ختامية، تحيط علماً بما قدمه الوفد من معلومات عن عدم وجود شكاوى تتعلق بالتمييز العنصري.

9. The Committee commends the State party's policy of promoting understanding and a culture of social harmony among the different sectors of society, but finds it regrettable that the State party considers the Absence of complaints and court decisions on the matter as proof that there is no racial discrimination in Cameroon (art. 6).
٩- ترحب اللجنة بالسياسة التي تعتمدها الدولة الطرف لتعزيز التفاهم وثقافة الوئام الاجتماعي بين مختلف مكونات المجتمع الكاميروني، لكنها تعرب عن أسفها إزاء استشهادها بعدم وجود شكاوى وقرارات قضائية بهذا الشأن كحجة على خلو الكاميرون من ظاهرة التمييز العنصري (المادة 6).
