4. On 18 July 2009, Mr. Abu Haikal arrived in Saudi Arabia at King Khalid International Airport in Riyadh at around 8.00 p.m. He was arrested by the Saudi Security Services upon arrival and his family had no news of his fate or whereabouts for the following nine months.
4- وفي 18 تموز/يوليه 2009 وصل السيد أبو هيكل إلى المملكة العربية السعودية عبر مطار الملك خالد الدولي بالرياض في حوالي الساعة الثامنة مساءً.

7. According to the source, in early February 2011, Mr. Abu Haikal was brought before a judge, without being allowed the presence of a lawyer, and was immediately sentenced to two years' imprisonment counting from the moment of his arrest.
7- ووفقاً للمصدر أحيل السيد أبو هيكل في أوائل شباط/فبراير 2011 إلى قاضٍ، دون السماح بحضور محامٍ، وحكم عليه فوراً بالسجن لمدة سنتين تُحسب ابتداءً من لحظة إلقاء القبض عليه.

Mr. Abu Haikal's family, who were at last able to meet him in February 2011, requested a copy of the sentence, but were told by the authorities not to make such requests as otherwise this would only worsen the fate of their son.
وطلبت أسرة السيد أبو هيكل التي تمكنت أخيراً من الالتقاء به في شباط/فبراير 2011، الحصول على نسخة من الحكم، لكن السلطات أعلمتها بعدم تقديم طلب كهذا، لأن ذلك سيؤدي إلى تردي مصير أبنها.

Despite having served the two-year term which ended on 28 June 2011, Mr. Abu Haikal remains detained in Al-Hayr Prison in Saudi Arabia with no legal justification.
وعلى الرغم من أن السيد أبو هيكل قد قضى مدة سجنه التي انتهت في 28 حزيران/يونيه 2011، فهو لا يزال محتجزاً في سجن الحاير بالسعودية دون أي تبرير قانوني.

8. The Working Group transmitted the above allegations to the Government of Saudi Arabia requesting that it provide, in its reply, detailed information about the current situation of Mr. Abu Haikal and clarify the legal provisions justifying his continued detention.
8- أحال الفريق العامل الادعاءات أعلاه إلى حكومة المملكة العربية السعودية وطلب منها أن تقدم، في ردها، معلومات مفصلة عن الوضع الراهن للسيد أبو هيكل وأن توضح الأحكام القانونية التي تبرر استمرار احتجازه.

14. Mr. Abu Haikal's detention also runs contrary to article 9 of the Universal Declaration of Human Rights which stipulates that no one may be subjected to arbitrary arrest or detention.
14- ويتعارض احتجاز السيد أبو هيكل أيضاً مع المادة 9 من الإعلان العالمي لحقوق الإنسان التي تنص على أنه لا يجوز القبض على أي إنسان أو حجزه تعسفاً.

18. Consequent upon the opinion rendered, the Working Group requests the Government of Saudi Arabia to release Mr. Abu Haikal forthwith and bring his situation in conformity with the standards and principles set forth in the Universal Declaration of Human Rights.
18- وبناءً على هذا الرأي، يطلب الفريق العامل من حكومة المملكة العربية السعودية إطلاق سراح السيد أبو هيكل فوراً وتصحيح وضعه ليتطابق مع المعايير والمبادئ المنصوص عليها في الإعلان العالمي لحقوق الإنسان.

19. In view of the adverse effect of this wrongful arrest and detention on Mr. Abu Haikal and his family, the Working Group requests the Government of Saudi Arabia to ensure appropriate reparation.
19- ونظراً للآثار السلبية التي لحقت بالسيد أبو هيكل وأسرته بسبب هذا الاعتقال والاحتجاز غير القانونيين، فإن الفريق العامل يطلب من حكومة المملكة العربية السعودية ضمان تقديم تعويض مناسب.

5. In March 2010, Mr. Abu Haikal was able to call his family, and from then on was allowed weekly 10-minute calls and his parents were also allowed to visit him in April 2010 at Al-Hayr Prison near Riyadh.
5- وفي آذار/مارس 2010، تمكن السيد أبو هيكل من الاتصال هاتفياً بأسرته، وسمح له منذ ذلك الحين بالاتصال بأسرته أسبوعياً والتحدث معها لمدة عشر دقائق وسمح لوالديه أيضاً بزيارته في نيسان/أبريل 2010 في سجن الحاير بالقرب من الرياض.

6. When Mr. Abu Haikal reappeared after nine months of disappearance, he had neither been notified of the charges against him nor presented before a judge and given the possibility to challenge the legality of his detention since the day of his arrest 16 months previously.
6- وعندما ظهر السيد أبو هيكل من جديد بعد مرور تسعة أشهر على اختفائه، لم يكن قد أُعلم بالتهم الموجهة إليه كما أنه لم يمثل أمام قاضٍ ولم تتح له إمكانية الاعتراض على قانونية احتجازه منذ اليوم الأول لإلقاء القبض عليه قبل 16 شهراً.

12. For the first nine months of his detention (18 July 2009 - March 2010), Mr. Abu Haikal had been made to disappear, as he was held without contact with the outside world and the Government refused to recognize his detention.
12- أُخفي السيد أبو هيكل خلال الأشهر التسعة الأولى من اعتقاله (18 تموز/ يوليه 2009 - آذار/مارس 2010)، لأنه احتُجز ومُنع من الاتصال بالعالم الخارجي ولأن الحكومة رفضت الاعتراف باحتجازه.

His family in Lebanon was unaware of his fate or whereabouts and repeated inquiries with the Saudi authorities brought no response. During the period between July 2009 and February 2011, Mr. Abu Haikal was never informed of the charges against him, brought before a judge or tried.
وكانت أسرته في لبنان تجهل مصيره أو مكان وجوده وظلت التساؤلات المتكررة الموجه إلى السلطات السعودية دون رد.وخلال الفترة بين تموز/يوليه 2009 وشباط/فبراير 2011، لم يُعلم السيد أبو هيكل مطلقاً بالتهم الموجه ضده، ولم يمثل أمام قاضٍ ولم يحاكم.

In this context, Mr. Abu Haikal's case was submitted to the Working Group on Enforced and Involuntary Disappearances on 15 October 2009 which considered and transmitted it to the Government of the Kingdom of Saudi Arabia.
وألقت دائرة الأمن السعودية القبض عليه حال وصوله ولم تعلم أسرته عن مصيره أو عن مكان وجوده خلال تسعة أشهر تلت ذلك، وفي هذا السياق، قدمت حالة السيد أبو هيكل إلى الفريق العام المعني بحالات الاختفاء القسري أو غير الطوعي، في 15 تشرين الأول/أكتوبر 2009، حيث نظر فيها وأحالها إلى حكومة المملكة العربية السعودية.
