ILO Convention No. 143 of 1975 concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers provides that a migrant who has resided legally in the territory for the purpose of employment shall not be regarded as in an irregular situation by the mere fact of the loss of his employment.

3. CESCR urged Mauritius to ratify ILO Convention No. 143 concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.

16. The Committee notes that the State party has still not acceded to International Labour Organization (ILO) Convention No. 97 (1949) concerning Migration for Employment, or to Convention No. 143 (1975), concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.
16- وتحيط اللجنة علماً بأن الدولة الطرف لم تنضم بعد إلى اتفاقية منظمة العمل الدولية رقم 97 بشأن العمال المهاجرين، لعام 1949، ولا إلى الاتفاقية رقم 143 بشأن الهجرة في أوضاع اعتسافية وتعزيز تكافؤ الفرص والمعاملة للعمال المهاجرين، لعام 1975.

This provision echoes article 9, paragraph 1, of ILO Convention No. 143 (1975) concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers (Supplementary Provisions).

13. The Committee notes that the State party has still not ratified the International Labour Organization (ILO) Convention concerning Migration for Employment (Revised 1949) (No. 97) or the ILO Convention concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers (No. 143).
13- وتلاحظ اللجنة أن الدولة الطرف لم توقع بعد على اتفاقيتي منظمة العمل الدولية بشأن العمال المهاجرين (المنقحة في عام 1994) (رقم 97) أو اتفاقية الهجرة في أوضاع اعتسافية وتعزيز تكافؤ الفرص والمعاملة للعمال المهاجرين (رقم 143).

It further recommends that the State party ratify the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families and ILO Convention No. 143 (1975) concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.
وتوصي اللجنة كذلك الدولة الطرف بأن تُصدِّق على الاتفاقية الدولية لحماية حقوق جميع العمال المهاجرين وأفراد أُسرهم، واتفاقية منظمة العمل الدولية رقم 143(1975) بشأن الهجرة في أوضاع اعتسافية وتعزيز تكافؤ الفرص والمعاملة للعمال المهاجرين.

8. The Committee notes that the State party has not yet become a party to ILO Conventions No. 97 (revised, 1949) concerning migration for employment, No. 143 (1975) concerning migrations in Abusive Conditions and the Promotion of equality of opportunity and treatment of migrant workers and No. 189 (2011) concerning decent work for domestic workers.

In 2010, the Special Rapporteur on the human rights of migrants recommended that the Government consider ratifying the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (ICRMW) and ILO Convention No. 143 concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.

2. CMW invited Bolivia to accede to ILO Conventions No. 97 (1949) concerning Migration for Employment and No. 143 (1975) concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers.
