V. Right of access to and enjoyment of cultural heritage
خامساً - الحق في الوصول إلى التراث الثقافي والتمتع به

58. access to and enjoyment of cultural heritage are interdependent concepts - one implying the other.
58- إن الوصول إلى التراث الثقافي والتمتع به مفهومان مترابطان - يدلّ أحدهما ضمناً على الآخر.

(i) Tourism and entertainment industries should respect the right of access to and enjoyment of cultural heritage.
(ط) ينبغي لصناعات السياحة والترفيه أن تحترم الحق في الوصول إلى التراث الثقافي والتمتع به.

2. Considering access to and enjoyment of cultural heritage as a human right is a necessary and complementary approach to the preservation/safeguard of cultural heritage.
2- واعتبار الوصول إلى التراث الثقافي والتمتع به حقاً من حقوق الإنسان نهج ضروري ومكمّل للحفاظ على التراث الثقافي وصيانته.

There is a better understanding today that, in order to respect and protect cultural identity, tangible cultural heritage should be preserved with a view to maintaining its authenticity and integrity, intangible cultural heritage should be safeguarded to ensure viability and continuity, and rights of access to and enjoyment of cultural heritage should be guaranteed.
وهناك اليوم فهم مؤداه أن التراث الثقافي المادي ينبغي حفظه بغية الإبقاء على أصالته وسلامته والتراث الثقافي غير المادي ينبغي أن يصان لكفالة استدامته واستمراره وينبغي ضمان حقوق الوصول إلى التراث الثقافي والتمتع به وذلك بغية كفالة الاحترام والحماية للهوية الثقافية.

33. In international human rights treaties, a number of provisions constitute a legal basis of a right of access to and enjoyment of cultural heritage.
33- تتضمن المعاهدات الدولية لحقوق الإنسان عدداً من الأحكام التي تشكل الأساس القانوني للحق في الوصول إلى التراث الثقافي والتمتع به.

Therefore, the right of access to and enjoyment of cultural heritage must be considered both as an individual and a collective human right.
وعليه، يجب أن يعتبر الحق في الوصول إلى التراث الثقافي والتمتع به بصفته حقاً من حقوق الإنسان فردياً وجماعياً().

69. States also have international obligations, mainly to foster assistance and cooperation to protect and promote access to and enjoyment of cultural heritage.
69- وعلى الدول أيضاً التزامات دولية، تتمثل أساساً في دعم المساعدة والتعاون على حماية وتعزيز الوصول إلى التراث الثقافي والتمتع به().

40. In this regard, the Independent Expert recalls that the right of access to and enjoyment of cultural heritage includes the right of individuals and communities to, inter alia, know, understand, enter, visit, make use of, maintain, exchange and develop cultural heritage, as well as to benefit from the cultural heritage and the creation of others.
40- وفي هذا الصدد، تذكر الخبيرة المستقلة بأن الحق في الوصول إلى التراث الثقافي والتمتع به يشمل حق الأفراد والجماعات في جملة أمور منها معرفة التراث الثقافي وفهمه والدخول إليه وزيارة مواقعه واستعماله وحفظه وتبادله وتطويره، إلى جانب الاستفادة من التراث الثقافي للآخرين ومن إبداعاتهم.

The principle of non-discrimination should be robustly reaffirmed in this regard. More generally, effective remedies, including judicial remedies, should be made available to individuals and communities who feel that their cultural heritage is not fully respected and/or protected, or that their right of access to and enjoyment of cultural heritage has been infringed upon.
وينبغي تأكيد مبدأ عدم التمييز من جديد، وبصفة أعم، إتاحة سبل انتصاف فعّالة، بما فيها سبل الانتصاف القضائية للأفراد والمجتمعات الذين يشعرون بعدم احترام و/أو حماية تراثهم الثقافي على النحو الكامل، أو بانتهاك حقوقهم في الوصول إلى التراث الثقافي والتمتع به.

78. The right of access to and enjoyment of cultural heritage forms part of international human rights law, finding its legal basis, in particular, in the right to take part in cultural life, the right of members of minorities to enjoy their own culture, and the right of indigenous peoples to self-determination and to maintain, control, protect and develop cultural heritage.
78- ويمثل الحق في الوصول إلى التراث الثقافي والتمتع به جزءاً من القانون الدولي لحقوق الإنسان، وينبع في أساسه القانوني بصفة خاصة من الحق في المشاركة في الحياة الثقافية، وحق أفراد الأقليات في التمتع بثقافتهم، وحق الشعوب الأصلية في تقرير المصير وفي حفظ التراث الثقافي والسيطرة عليه وحمايته وتطويره.

79. The right of access to and enjoyment of cultural heritage includes the right of individuals and communities to, inter alia, know, understand, enter, visit, make use of, maintain, exchange and develop cultural heritage, as well as to benefit from the cultural heritage and the creation of others.
79- ويشمل الحق في الوصول إلى التراث الثقافي والتمتع به حق الأفراد والمجموعات في أمور منها معرفة التراث الثقافي وفهمه والدخول إليه وزيارة مواقعه واستعماله وحفظه وتبادله وتطويره، وكذلك الانتفاع من التراث الثقافي ومن إبداع الآخرين.

(k) States should adopt positive measures to ensure access to and enjoyment of cultural heritage by all people regardless of gender, including people with scarce financial resources, and those with mental and physical disabilities;
(ك) ينبغي للدول أن تعتمد تدابير إيجابية لضمان الوصول إلى التراث الثقافي والتمتع به من جانب جميع الأشخاص بغض النظر عن نوع الجنس، بما في ذلك الأشخاص الذين يعانون من ندرة الموارد المالية، والأشخاص ذوي الإعاقات العقلية والبدنية؛

(l) States should make available effective remedies, including judicial remedies, to concerned individuals and communities who feel that their cultural heritage is either not fully respected and protected or that their right of access to and enjoyment of cultural heritage is being infringed upon.
(ل) ينبغي للدول أن تتيح سُبُل التظلم الفعالة، بما فيها سُبُل التظلم القضائية، للأفراد والمجتمعات المعنية التي تشعر بعدم احترام وحماية تراثها الثقافي بصورة كاملة أو بانتهاك حقوقها في الوصول إلى التراث الثقافي والتمتع به.

The Independent Expert in the field of cultural rights has stated " in order to respect and protect cultural identity, tangible cultural heritage should be preserved with a view to maintaining its authenticity and integrity, intangible cultural heritage should be safeguarded to ensure viability and continuity, and the rights of access to and enjoyment of cultural heritage should be guaranteed. وذكرت الخبيرة المستقلة في ميدان الحقوق الثقافية " أن التراث الثقافي المادي ينبغي حفظه بغية الإبقاء على أصالته وسلامته، والتراث الثقافي غير المادي ينبغي أن يصان لكفالة استدامته واستمراره وينبغي ضمان حقوق الوصول إلى التراث الثقافي والتمتع به وذلك بغية كفالة الاحترام والحماية للهوية الثقافية " ().
