The Committee regrets the lack of data on the acts covered by the Optional Protocol, relating in particular to asylum-seeking, refugee, migrant and unaccompanied children under the State party's jurisdiction, who may have been recruited or used in hostilities abroad.

The Working Group recommended, inter alia, that the Conference should urge States parties that had not yet done so to review and strengthen their criminal legislation and to establish as criminal offences the acts covered by the Firearms Protocol, including by introducing sanctions commensurate with the nature and gravity of the offence.

Article 87 bis 4 reads as follows: " Anyone who justifies, encourages or finances the acts covered by this section by any means shall be subject to 5 to 10 years' imprisonment and a fine of DA 100,000 to DA 500,000 " .

Switzerland has considered criminalizing trading in influence but eventually decided against this option, preferring to punish the acts covered by the Convention under the provisions on active and passive bribery, although these seem not to cover all cases of trading in influence.

The latter draft article, the first in Part Three (Immunity ratione materiae), did no more than state which persons enjoyed such immunity; draft articles should be added on the nature of acts covered by immunity ratione materiae.

(b) Urge States parties to further strengthen their legal frameworks to prevent and combat emerging forms of crime in a manner consistent with international instruments, such as the Organized Crime Convention, and consider establishing as criminal offences the acts covered by those instruments;

Requests those States parties to the United Nations Convention against Corruption that have not yet done so to adapt their legislation and regulations, pursuant to article 65 of the Convention, in order to comply with the obligation to establish as criminal offences the acts covered by the Convention in articles 15, 16 (paragraph 1), 17, 23 and 25;

If States parties wish to establish specific acts, including new forms and dimensions of organized crime, as criminal offences, in addition to the acts covered by articles 5, 6, 8 and 23 of the Convention or by its Protocols, there will be the need for a common approach among States parties: to stipulate that deprivation of liberty for at least four years should be the penalty for such offences.
5- وإذا ما أرادت الدول الأطرف أن تجرِّم أفعالا محددة، بما يشمل الأشكال والأبعاد الجديدة للجريمة المنظمة، بالإضافة إلى الأفعال المشمولة بالمواد 5 و6 و8 و23 من الاتفاقية وأحكام البروتوكول، فسوف يلزم اتّباع نهج مشترك بين الدول الأطراف: أي النصّ على أن تكون العقوبة على هذه الجرائم الحرمان من الحرية لمدة لا تقل عن أربع سنوات.

Article 87 bis 5 reads as follows: " Anyone who knowingly reproduces or disseminates printed documents or recordings that seek to justify the acts covered by this section shall be subject to 5 to 10 years' imprisonment and a fine of DA 100,000 to DA 500,000 " .

He believes, however, that the acts covered by the draft article could be prosecuted as acts of aggression and that there might, as a result, be no need to devote a separate article to them.

The Committee also regrets the State party's position that its judicial cooperation agreements regarding criminal proceedings and extradition are not applicable because acts covered by the Optional Protocol do not amount to criminal offences in the State party.
وتعرب اللجنة أيضاً عن أسفها لموقف الدولة الطرف القائل بأنّ اتفاقات التعاون القضائي المتعلقة بالإجراءات الجنائية وتسليم المجرمين غير قابلة للتطبيق لأنّ الأعمال الواردة في البروتوكول الاختياري لا ترقى إلى مستوى الجرائم الجنائية في الدولة الطرف.
