وهكذا تسمح الاتفاقية لدول غير دولة العلم بممارسة الولاية العالمية في المعاقبة على جريمة تلويث أعالي البحار وذلك على غرار جريمة القرصنة التي تعاقب عليها جميع الدول باعتبارها جريمة ترتكب ضد قانون اﻷمم.

The Forfeiture Act, also applicable to MLA, covers, inter alia: search for and seizure of tainted property; interim restraining orders and productive orders; and search warrants in relation to foreign serious offences, which are serious offences against the law of a foreign country (ss. 40, 52 and 63).

in the case of an offence against the law of a designated country, it is an offence which, however described in that law, falls within any of the descriptions set out in Schedule 1 to this Act, and is punishable under the law with imprisonment for a term of 12 months or any greater punishment;

(ب) وفي جميع الأحوال، فإن الفعل أو عدم الفعل الذي يشكل جريمة ضد الفعل أو عدم الفعل المساوي له، إنما يشكل جريمة ضد قانون تونغا إذا ما وقع ضمن تونغا أو، في حالة الجريمة الواقعة خارج أراضيها، في ظروف مقابلة خارج تونغا.

(2) In determining for the purposes of this section whether an offence against the law of a designated country falls within a description set out in Schedule 1 of this Act, any special intent or state of mind or special circumstances of aggravation which may be necessary to constitute that offence under the law shall be disregarded.
(2) عند البت لأغراض هذه المادة فيما إذا كانت الجريمة المرتكبة ضد قانون بلد معين تقع ضمن الوصف المحدد في الجدول 1 من هذا القانون، لا يُكترث بأي نية خاصة أو حالة ذهنية خاصة أو ظروف خاصة من ظروف التشديد، التي يمكن أن تكون ضرورية لاعتبارها جريمة بموجب القانون.

Under the Order 2006, political offence in relation to a country is defined as an offence against the law of the country that is of a political character (whether because of the circumstances in which it is committed or otherwise and whether or not there are competing political parties in the country).

(3) لأغراض المادة الفرعية (2) (أ) يعتبر البيان الوارد في الطلب الأجنبي الذي يفيد بأن فعلا خطيرا قد ارتكب أو يحتمل ارتكابه يتعارض مع قانون دولة أجنبية دليلا كافيا للواقعة دون إثبات لتوقيع الشخص الذي يبدو أنه قد وقع البيان أو للطابع الرسمي له.

(3) For the purposes of the subsection (2) (a), a statement contained in the foreign request to the effect that a serious offence has been or may have been committed against the law of the foreign State is prima facie evidence of the fact without proof of the signature or official character of the person appearing to have signed the statement.
