Notwithstanding the statement by the delegation that voluntary recruitment into the armed forces of persons under 18 is prohibited under domestic law, the Committee notes that the State party's declaration upon ratification of the Optional Protocol that 16 years constitute the minimum age for voluntary recruitment into the armed forces is still in place and was confirmed in the written replies of the State party.

The Committee welcomes the State party's declaration made upon the ratification of the Optional Protocol that the minimum age for voluntary recruitment into the Belgian armed forces is not lower than 18 years and that it is absolutely forbidden under Belgian law for any person under the age of 18 years to participate in times of war and in times of peace in any peacekeeping operation or in any kind of armed operational engagement.

(b) The Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict (2000) sets 18 as the age-limit for compulsory recruitment and participation in hostilities and 16 as the minimum age for voluntary recruitment into national armed forces; it also prohibits insurgent armed groups, " under any circumstances " , from recruiting persons under the age of 18 or using them in hostilities;
(ب) البروتوكول الاختياري الملحق باتفاقية حقوق الطفل بشأن مشاركة الأطفال في النـزاع المسلح (2000) يحدد سن التجنيد الإجباري والاشتراك في القتال ب18 سنة، والحد الأدنى لسن التجنيد الطوعي في القوات المسلحة الوطنية ب16 سنة؛ كما يحظر على المجموعات المسلحة المتمردة، " في ظل أية ظروف " ، تجنيد أشخاص دون سن ال18 سنة أو استخدامهم في القتال؛
