However, due to the unique security situation on the Korean peninsula, my Government is not able to take an active stance on the Convention on Cluster Munitions, which bans the use of all cluster munitions.

The United Nations has recently urged all Member States to address immediately the horrendous effects of cluster munitions by concluding a legally binding instrument and has called on States to take domestic measures to immediately freeze the use and transfer of all cluster munitions until such a treaty is adopted.

What was important was to have an effective international instrument which banned all cluster munitions and called for their destruction, unless governments could demonstrate that there were cluster munitions that were reliable and accurate and could be used without presenting unacceptable dangers to civilians during or after attacks.

(b) destroy or ensure the destruction, in accordance with national procedures, of all cluster munitions prohibited by this Protocol that are under its jurisdiction and control as soon as feasible, starting no later than:
(ب) يدمر أو يضمن تدمير جميع الذخائر العنقودية المحظورة بموجب هذا البروتوكول والمشمولة بولايته والخاضعة لسيطرته في أقرب وقت ممكن، وفق الإجراءات الوطنية، على أن يبدأ ذلك في موعد لا يتجاوز:

2 - تتعهد كل دولة طرف بتدمير أو ضمان تدمير كل الذخائر العنقودية المشار إليها في الفقرة 1 من هذه المادة في أقرب وقت ممكن على ألا يتعدى ذلك ثماني سنوات من دخول هذه الاتفاقية حيز النفاذ بالنسبة لتلك الدولة الطرف.

On the other hand, the adoption of a transfer ban, if based on an understanding that all cluster munitions were prohibited, would definitely add value.
102- ومن ناحية أخرى، فإن اعتماد الحظر على النقل، إذا استند إلى فهم مؤداه أن كل الذخائر العنقودية مشمولة بالحظر، من شأنه أن يضيف قيمة، بما لا ريب فيه.
