Article 94 of UNCLOS sets out the duties of a flag State and requires that all flag States shall effectively exercise jurisdiction and control over administrative, technical, social and labour matters over ships flying their flag, and in doing so, flag States are required to conform to generally accepted international regulations, procedures and practices and to take any steps which may be necessary to secure their observance.

79. Welcomes the audits that have been completed pursuant to the Voluntary International Maritime Organization Member State Audit Scheme and the Code for the implementation of mandatory International Maritime Organization instruments, and encourages all flag States to volunteer to be audited;

A further 16 member States have formally indicated their readiness to be audited.61 The General Assembly has encouraged all flag States to volunteer to be audited (see resolution 62/215, para. 79).

9. In its report on the session, the Commission invited IMO to develop, as a matter of urgency, measures in binding form to ensure that ships of all flag States meet international rules and standards so as to give full and complete effect to the 1982 United Nations Convention on the Law of the Sea (article 91) as well as other relevant conventions.

That initiative was in line with decision 7/1 of the Commission on Sustainable Development, which had proposed that IMO should develop binding measures to ensure that all flag States should comply with the international rules and standards, so as to give full and complete effect to the Convention.
وقال إن تلك المبادرة تتمشى مع مقرر لجنة التنمية المستدامة 7/1 الذي ورد فيه اقتراح بأن تضع المنظمة تدابير ملزمة لضمان امتثال دول العَلم بالقواعد والمعايير الدولية، بحيث تصبح اتفاقية الأمم المتحدة لقانون البحار نافذة المفعول بشكل تام وفعلي.

(h) Call upon all flag States to ensure that vessels flying their flag do not engage in trans-shipments of fish caught by fishing vessels engaged in illegal, unreported and unregulated fishing; and upon States, individually or through regional fisheries management organizations, to develop more effective enforcement and compliance measures to prevent and suppress such trans-shipments in accordance with international law;
