4.3 The decision to bring this case before the Committee and not the European Court of Human Rights, while the author also alleged violations of articles 9 and 14 of the European Convention on Human Rights before the domestic courts, is motivated by a desire to obtain a decision from the Committee differing from the one already adopted by the Court.

4.3 Concerning the alleged violations of articles 6 and 7 in the event of a return to Iran, the State party argues that the facts, as determined by its courts, do not support these allegations.

11.4 With regard to the alleged violations of articles 14 and 15 of the Convention, the Committee notes that the scope of application of the said provisions only refers to torture in the sense of article 1 of the Convention and does not cover other forms of ill-treatment.

5.3 The authors note that, with respect to the State party's claim that no prima facie case has been made by the authors in relation to alleged violations of articles 9 and 13, it is not explained how an action could be taken alleging a violation of the New Zealand Bill of Rights Act 1990.

8.8 Concerning the perpetrators of the alleged violations of articles 1 and 16 of the Convention, the complainants submit that although only a public official or a person acting in an official capacity could be the perpetrator of an act in the sense of either of the above provisions, both provisions state that the act of torture or of other ill-treatment may also be inflicted with the consent or acquiescence of a public official.

The State party's failure to consider these applications are also said to demonstrate that exhaustion of domestic remedies with respect to the alleged violations of articles 7 and 10, paragraph 1 has been unduly prolonged, and that the remedies are ineffective.
