President Jorda observed that, in order for the Tribunal to be able to award compensation in those situations, it would be necessary for the Security Council to amend the statute of the Tribunal so as to confer upon it the necessary legal powers.

1. Decides to amend the statute of the United Nations Administrative Tribunal ( " the Statute " ), with effect from 1 January 2001, as follows:
1 - تقرر تعديل النظام الأساسي للمحكمة الإدارية للأمم المتحدة ( " النظام الأساسي " ) على النحو التالي، اعتبارا من 1 كانون الثاني/يناير 2001:

In its resolution 2003/57 of 24 July 2003, the Economic and Social Council decided to amend the statute of the Institute, including the establishment of an Executive Board of INSTRAW to replace the Board of Trustees; and also requested the Secretary-General to report to the Assembly at its fifty-ninth session on the implementation of Council resolution 2003/57.
وفي قراره 2003/57 المؤرخ 24 تموز/ يوليه 2003، قرر المجلس الاقتصادي والاجتماعي تعديل النظام الأساسي للمعهد، بما في ذلك تشكيل مجلس تنفيذي للمعهد يحل مكان مجلس الأمناء؛ وطلب أيضا إلى الأمين العام أن يقدم تقريرا إلى الجمعية في دورتها التاسعة والخمسين عن تنفيذ قرار المجلس 2003/57.

10. In paragraph 5 of the draft resolution, the Economic and Social Council would be requested to amend the statute of the International Research and Training Institute for the Advancement of Women, where necessary, in order to permit the implementation of the measures contained in paragraphs 3 and 4 of the draft resolution.

8. In view of the foregoing the General Assembly rightly decided in its resolution 50/54 of 11 December 1995 to amend the statute of the United Nations Administrative Tribunal by deleting article 11, which provided staff members with an opportunity to appeal to the International Court of Justice.

As far as recommendation 2 (b) is concerned, CEB members note that attributing to the United Nations Administrative Tribunal the power " to mediate between parties " to a dispute (e.g., a staff member appealing an administrative decision by management) raises a number of issues, including the need to amend the statute of the Tribunal.

Subsequently, in order to enable the Tribunal to conclude its work at the earliest possible date, the Security Council, in its resolution 1329 (2000) of 30 November 2000, decided to amend the statute of the Tribunal to allow for the establishment of a pool of ad litem judges.

In view of the goal of creating a transparent system of justice, delegations also considered it unnecessary to amend the statute of the United Nations Dispute Tribunal regarding redaction of names as proposed in the report of the Secretary-General (ibid., para. 263), since provisions concerning the protection of personal data already existed in the rules of procedure.
