An amended Criminal Code, which entered into force in May 2012, regulates the following:

22. The amended Criminal Code defined the offence of trafficking in persons as promoting, facilitating or encouraging a person of either sex to enter or leave the country for the purpose of engaging in prostitution or in order to maintain another person in sexual or other servitude.

1. The newly amended Criminal Code stipulates that any acts of abduction, buying, trafficking, fetching, sending or transferring of women and children shall constitute the crime of abduction of and trafficking in women and children, and shall be punishable, according to the circumstances by fixed-term imprisonment, life imprisonment or even death. Such acts shall also entail a fine or confiscation of property.

The Committee is also concerned that, although trafficking in persons carries a maximum penalty of 15 years' imprisonment under article 154 of the amended Criminal Code, in most cases, the courts administer significantly lower prison sentences under article 165, for " sending a person for sexual exploitation " .
