The State party should revise the Code of Criminal Procedure to include clear provisions on the obligation of the competent authorities to systematically launch objective and impartial investigations, without consultation and without first receiving a complaint from the victim, whenever there are reasonable grounds for believing that an act of torture has been committed.
ينبغي للدولة الطرف أن تنقّح قانون الإجراءات الجنائية لكي تُضمّنه أحكاماً واضحة بشأن التزام السلطات المختصة بعدم التواني عن فتح تحقيق موضوعي ونزيه بصورة منهجية، ودون وجود شكوى مسبقة من الضحية، في جميع الحالات التي تتوافر فيها أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتُكب.

In addition, the State party should ensure that where there is reasonable ground to believe that an act of torture has been committed, impartial and effective investigations should be launched immediately, even in cases where a commanding officer considers that the allegation is not well-founded.

7.3 The Committee considers that the points outlined in the previous paragraph indicate a failure to investigate on the part of the authorities mentioned therein that is incompatible with the obligation on the State, under article 12 of the Convention, to ensure that its competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed.
7-3 وترى اللجنة أن النقاط الواردة في الفقرة السابقة تشير إلى وجود قصور في التحقيق من جانب السلطات المذكورة في تلك الفقرة لا يتفق مع التزام الدولة بموجب المادة 12 من الاتفاقية بضمان قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه كلما كانت هناك أسباب معقولة تدعو للاعتقاد بأن فعل من أفعال التعذيب قد ارتكب.

Article 12 of the Convention against Torture expressly obligates States parties to investigate all allegations of torture, asserting that each State party should ensure that its competent authorities proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.
49- وتلزم المادة 12 من اتفاقية مناهضة التعذيب صراحة الدول الأطراف بالتحقيق في جميع ادعاءات التعذيب، وتؤكد أن على كل دولة طرف أن تضمن قيام سلطاتها المختصة بتحقيق فوري ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها القضائية.

10.6 In the light of the above, the Committee considers that there was a failure on the part of the authorities to conduct an investigation and that this was incompatible with the State party's obligations under article 12 of the Convention to ensure that the authorities proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed.

6. A national mechanism should be set up with extensive powers to carry out swift and impartial investigations, where there are reasonable grounds to suppose that an act of torture has been committed in territory subject to the jurisdiction of the State, and torture cases should be classified as urgent cases.
6- أهمية وجود جهاز وطني تخول له صلاحيات واسعة لإجراء تحقيق سريع ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب في أي من المناطق الخاضعة لولاية الدولة القضائية واعتبار قضايا التعذيب من القضايا المستعجلة.

The complainant recalls that the Committee found the provisions not consistent with the obligation of every State party to conduct an impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed on territory under its jurisdiction, to prosecute the perpetrators of such acts and to compensate the victims.
