16. Following the day of general discussion, the Committee decided to prepare a general comment, No. 2, on the rights of migrant workers in an irregular situation and members of their families.

II. The normative framework for the protection of the rights of migrant workers in an irregular situation and members of their families

Migrant workers in an irregular situation and members of their families were particularly vulnerable to exploitation and abuse, including slavery, forced labour, torture and other inhuman treatment, violence, threats, intimidation, discrimination and lack of due process.

The Committee considers that in cases of extreme poverty and vulnerability, States parties should provide emergency social assistance to migrant workers in an irregular situation and members of their families, including emergency services for persons with disabilities, for as long as they might require it.
