3. The knowledge, intent or purpose required to combat an offence set forth in article 2, paragraph 2, or in paragraph 2 of this article may be inferred from objective factual circumstances.
٣ - يجوز الاستدلال من ظروف وقائعية موضوعية على المعرفة أو النية أو الغرض اللازم توفرها لمكافحة جريمة من الجرائم المنصوص عليها في الفقرة ٢ من المادة ٢ أو في الفقرة ٢ من هذه المادة .

1. Upon seizing or otherwise taking control of radioactive material, devices or nuclear facilities, following the commission of an offence set forth in article 2, the State Party in possession of such items shall:
1 - عند حجز مواد أو أجهزة مشعة أو مرافق نووية، أو السيطرة عليها عقب ارتكاب إحدى الجرائم المنصوص عليها في المادة 2، تقوم الدولة الطرف التي تحوزها بما يلي:

(a) Participates as an accomplice in an offence set forth in paragraph 1 or 2 of this article;
(أ) يساهم كشريك في جريمة منصوص عليها في الفقرة 1 أو 2 من هذه المادة؛

7. In the event of any dissemination in connection with an offence set forth in article 2, nothing in the present article shall affect in any way the rules of international law governing liability for nuclear damage, or other rules of international law.
7 - في حالة حدوث أي انتشار فيما يتصل بإحدى الجرائم المنصوص عليها في المادة 2، ليس في هـذه الاتفاقيـة ما يمس بأي طريقة قواعد القانون الدولي التي تحكم المسؤولية عن الضرر النووي أو قواعد القانون الدولي الأخرى.

1 - لدى تلقي دولة طرف معلومات تفيد بأن شخصا ارتكب جريمة من الجرائم المنصوص عليها في المادة 2 أو يُدَّعى أنه ارتكبها قد يكون موجودا في إقليمها، تتخذ الدولة الطرف المعنية ما يلزم من التدابير طبقا لقوانينها الداخلية للتحقيق في الوقائع المتضمنة في هذه المعلومات.

1. Upon receiving information that a person who has committed or who is alleged to have committed an offence set forth in article 2 of the present Convention may be present in its territory, the State Party concerned shall take such measures as may be necessary under its domestic law to investigate the facts contained in the information.
1 - لدى تلقي دولة طرف معلومات تفيد بأن شخصا ارتكب جريمة من الجرائم المنصوص عليها في المادة 2 من هذه الاتفاقية أو يُدَّعى أنه ارتكبها قد يكون موجودا في أراضيها، تتخذ الدولة الطرف المعنية ما يلزم من التدابير طبقا لقوانينها الداخلية للتحقيق في الوقائع المتضمنة في هذه المعلومات.

1. Each State Party, in accordance with its domestic legal principles, shall take the necessary measures to enable a legal entity located in its territory or organized under its laws to be held liable when a person responsible for the management or control of that legal entity has, in that capacity, committed an offence set forth in article 2.
١ - تتخذ كل دولة طرف التدابير اللازمة، وفقا لمبادئها القانونية الداخلية، للتمكين من أن يتحمل أي كيان اعتباري موجود في إقليمها أو منظم بموجب قوانينها المسؤولية إذا قام شخص مسؤول عن إدارة أو تسيير هذا الكيان، بصفته هذه، بارتكاب جريمة منصوص عليها في المادة ٢.

(b) Participating as an accomplice in an offence set forth in article 2, paragraph 2;
)ب( المشاركة في احدى الجرائم المنصوص عليها في الفقرة ٢ من المادة ٢ ؛

1. Each State Party shall adopt such measures as may be necessary, in accordance with principles of its domestic law, to establish the liability of a legal person situated in its territory or constituted in accordance with its legislation, when a person liable for its conduct or control commits, in such capacity, an offence set forth in this Convention.
1- تعتمد كل دولة طرف ما قد يلزم من تدابير، وفقا لمبادئ قانونها الداخلي، لتقرير مسؤولية الهيئة الاعتبارية التي توجد في إقليمها أو التي أنشئت وفقا لقوانينها، عندما يرتكب الشخص المسؤول عن تسيير شؤونها أو مراقبتها، بصفته تلك، جرما بمقتضى هذه الاتفاقية.

(ii) Be made in the knowledge of the intention of the group to commit an offence set forth in paragraph 1 of this article.
`2 ' بمعرفة نية المجموعة ارتكاب جريمة من الجرائم المشار إليها في الفقرة 1 من هذه المادة.

1. Upon receiving information that a person who has committed or who is alleged to have committed an offence set forth in article 2 may be present in its territory, the State Party concerned shall take such measures as may be necessary under its domestic law to investigate the facts contained in the information.
١ - عنـد تلقـي الدولة الطـرف معلومات تفيد بأن الفاعل أو المرتكب المفترض لجريمة مشار إليها في المادة ٢ قد يكون موجودا في إقليمها، تتخذ تلك الدولة الطرف التدابير اللازمة وفقا لتشريعاتها الداخلية للتحقيق في الوقائع التي أبلِغت بها.

2. Any person also commits an offence if that person attempts to commit an offence set forth in paragraph 1 of this article.
2 - يرتكب جريمة أيضا كل شخص يحاول ارتكاب جريمة من الجرائم المحددة في الفقرة 1 من هذه المادة.
