التوصية 31- عقب تلقي اقتراح غير ملتمس وفحصه فحصا أوليا، ينبغي للسلطة المتعاقدة أن تعلم مقدمه، في غضون فترة قصيرة معقولة من الزمن، بما إذا كانت هناك مصلحة عمومية محتملة في المشروع أم لا.

33. If an unsolicited proposal involves exclusive intellectual property rights, the current provisions allow the authority to negotiate directly with the proponent, though a general recommendation to seek to introduce competition, to the extent possible, is made.
٣٣- وإذا كان اقتراح غير ملتمس ينطوي على حقوق ملكية فكرية حصرية، فإنَّ الأحكام الحالية تتيح للسلطة التفاوض مباشرة مع مقدم الاقتراح، وإن كانت هناك توصية عامة بالسعي، قدر الإمكان، إلى الأخذ بالإجراءات التنافسية.

107. In the light of the above considerations, it is advisable for the contracting authority to establish transparent procedures for determining whether an unsolicited proposal meets the required conditions and whether it is in the contracting authority’s interest to pursue it.
107- من المستصوب، على ضوء الاعتبارات الآنفة الذكر، أن تضع السلطة المتعاقدة إجراءات شفافة للبت فيما إذا كان اقتراح غير ملتمس يفي بالشروط المطلوبة وما إذا كان في صالح السلطة المتعاقدة أن تسعى إلى تنفيذه.

Such a requirement should apply regardless of the method used by the contracting authority to select the concessionaire (for example, whether through competitive selection procedures, direct negotiations or as a result of an unsolicited proposal).
وينبغي أن ينطبق اشتراط كهذا بصرف النظر عن الأسلوب الذي تتبعه السلطة المتعاقدة في اختيار صاحب الامتياز (مثلا، بإجراء عمليات اختيار تنافسية أو مفاوضات مباشرة أو نتيجة اقتراح غير ملتمس).

30. The experts note that the mere fact that an unsolicited proposal may be in the public interest (i.e., it meets a previously unidentified need) is not sufficient to permit direct negotiations without competition.
٣٠- ويلاحظ الخبراء أنَّ مجرد احتمال أن يصبَّ اقتراح غير ملتمس في المصلحة العامة (أي يلبي حاجة لم تكن مستبانة من قبل) ليس كافياً للسماح بالتفاوض المباشر دون منافسة.

That the contracting authority should request the authors of an unsolicited proposal to submit an initial proposal containing sufficient information to allow the contracting authority to make a prima facie assessment of whether the conditions for handling unsolicited proposals are met, in particular whether the proposed project is in the public interest;

٩١١ - من المستصوب ، على ضوء الاعتبارات آنفة الذكر ، أن تضع الهيئة المتعاقدة اجراءات شفافة للبت فيما اذا كان اقتراح غير ملتمس يفي بالشروط المطلوبة وما اذا كان في صالح الهيئة المتعاقدة أن تسعى الى تنفيذه .

114. In connection with paragraph 1, it was pointed out that at such an early stage of examination of an unsolicited proposal there could not be a final determination as to whether or not a project was in the public interest.
114- وفيما يتعلق بالفقرة 1، أشير الى أنه لا يمكن في هذه المرحلة المبكرة من فحص الاقتراح غير الملتمس أن يتقرر نهائيا ما اذا كان المشروع سيخدم المصلحة العامة أم لا.
