38. The Committee reiterates its previous recommendation (CRC/C/15/Add.178, para. 22) that legislation governing procedure in courts and administrative proceedings ensure that a child capable of forming his/her own views has the right to express those views and that they are given due weight.
38- تؤكِّد اللجنة من جديد توصيتها السابقة (CRC/C/15/Add.178، الفقرة 22) بأن تكفل التشريعات التي تحكم الإجراءات المتَّبعة في المحاكم والإجراءات الإدارية للطفل القادر على تكوين آرائه الذاتية الحق في التعبير عن تلك الآراء وبأن تُولى الأهمية الواجبة.

Furthermore, it recommends that the State party take further steps to consistently reflect the obligations of both paragraphs of article 12 in legislation, and that legislation governing court procedures and administrative proceedings (including divorce and separation proceedings) ensure that a child capable of forming his/her own views has the right to express those views and that they are given due weight.
