It therefore stresses the importance of the advisory opinion of the International Court of Justice, which unanimously found that there exists an obligation to pursue in good faith and bring to a conclusion negotiations leading to nuclear disarmament in all its aspects under strict and effective international control.
وهي لذلك تؤكد على أهمية فتوى محكمة العدل الدولية، التي أشارت في حكمها الصادر بالإجماع إلى أن ثمة التزاماً قائماً بالسعي بحسن نية إلى إجراء مفاوضات تفضي إلى نزع السلاح النووي بكافة جوانبه في ظل رقابة دولية صارمة وفعالة، والوصول بتلك المفاوضات إلى نتيجة.

فالغرض من مشروع القرار هو حث جميع الدول اﻷعضاء على الوفاء بالتزامها بالدخول بنية حسنة في مفاوضات لوضع اتفاقية لﻷسلحة النووية، تؤدي إلى القضاء التام على هذه اﻷسلحة، واختتام هذه المفاوضات.

37 - لقد أكدت محكمة العدل الدولية، في فتواها التاريخية الصادرة عام 1996، ضرورة تنفيذ المادة السادسة تماما وبالكامل، فذكرت أن هناك التزاما بالسعي، بنيّة صادقة، إلى إجراء مفاوضات تُفضي إلى نزع السلاح النووي بجميع جوانبه في ظل رقابة دولية صارمة وفعالة، واختتام تلك المفاوضات.
