The Committee also notes with concern the lack of a comprehensive and effective complaints mechanism (art. 2).

(a) Consider establishing a specifically dedicated, independent and effective complaints body and ensure prompt, impartial and full investigations into all allegations of torture and ill-treatment committed by public officials, and to prosecute and punish those responsible with penalties taking into account the grave nature of offences;

(a) Ensure that juveniles in detention and pretrial detention have access to legal aid and independent and effective complaints mechanisms, and have the opportunity to remain in regular contact with their families;
(أ) ضمان حصول الأحداث المحتجزين والمحبوسين حبساً احتياطياً على المساعدة القانونية والوصول إلى آليات مستقلة وفعالة لتقديم الشكاوى وتوفير الفرص لهم لمواصلة الاتصال بأسرهم بانتظام؛

Factors that contribute to the current impunity for perpetrators include the lack of an independent and effective complaints mechanism for receiving allegations of torture; the failure of the courts to order investigations into allegations that evidence has been obtained through torture; and the lack of ex officio investigations.
34- وتشمل العوامل التي تعزز حالة إفلات الجناة من العقاب، السائدة حالياً، عدم وجود آليات مستقلة وفعالة لتقديم الشكاوى تتيح تلقي الادعاءات المتعلقة بالتعذيب؛ وتقاعس المحاكم عن الأمر بالتحقيق في ادعاءات اللجوء إلى التعذيب لانتزاع الأدلة؛ وعدم إجراء تحقيقات تلقائية.

According to article 12, States parties shall undertake prompt, effective and impartial investigations, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction as the result of its actions or omissions and, as set out in article 13 and affirmed by the Committee in its general comment No. 2, ensure that impartial and effective complaints mechanisms are established.
