190- ويخلص الفريق إلى أن إيران لم تفِ بشروط الإثبات لكي تتلقى تعويضاً بموجب المادة 35(3) من القواعد ومقرر مجلس الإدارة رقم 46.

8. The main legislative mandates for UNEP work with young people include chapter 25 of Agenda 21, " Children and youth in sustainable development " ; General Assembly resolution 50/81 on the World Programme of Action for Youth to the Year 2000 and Beyond; and Governing Council decision 22/18 II on engagement and involvement of young people in environmental issues.
8 - وتشمل التفويضات التشريعية الرئيسية لعمل البرنامج مع الشباب الفصل 25 من جدول أعمال القرن 21 " الأطفال والشباب في التنمية المستدامة " ؛ وقرار الجمعية العامة 50/81 " برنامج العمل العالمي للشباب حتى سنة 2000 وما بعدها " ؛ ومقرر مجلس الإدارة 22/18 ثانياً عن إشراك الشباب وإدماجهم في القضايا البيئية.

Pursuant to General Assembly resolution 57/251 and Governing Council decision 22/17 I, the Executive Director sent a letter on 16 June 2003 to all Governments, inviting them to submit by 31 October 2003 their views on the question of universal membership of the Governing Council/Global Ministerial Environment Forum.
12 - وفقاً لقرار الجمعية العامة 57/251 ومقرر مجلس الإدارة 22/17 أولاً، أرسل المدير التنفيذي خطاباً في 16 حزيران/يونيه 2003 لجميع الحكومات، يدعوها إلى أن تقدم آراءها بشأن مسألة عالمية عضوية مجلس الإدارة/المنتدى البيئي الوزاري العالمي في موعد غايته 31 تشرين الأول/أكتوبر 2003.

In pursuance of General Assembly resolution 57/251 and Governing Council decision 22/17, part I, the Executive Director sent a letter on 16 June 2003 to all Governments inviting them to submit by 31 October 2003 their views on the question of universal membership of the Governing Council/Global Ministerial Environment Forum.
9 - إعمالاً لقرار الجمعية العامة 57/251 ومقرر مجلس الإدارة 22/17، الجزء الأول، بعث المدير التنفيذي برسالة مؤرخة 16 حزيران/يونيه 2003 إلى جميع الحكومات يدعوها فيها لأن تقدم، آراءها في موعد أقصاه 31 تشرين الأول/أكتوبر 2003 حول مسألة العضوية العالمية لمجلس الإدارة/المنتدى البيئي الوزاري العالمي.

Saudi Arabia notes that decision 19 is " a one sentence ruling which does not purport to define or clarify the principles of compensation set out in Security Council resolution 687(1991) and Governing Council decision 7 " .
260- وتلاحظ العربية السعودية أن المقرر رقم 19 هو " قاعدة من جملة واحدة لا تدعي أنها توضح مبادئ التعويض المبينة في قرار مجلس الأمن رقم 687(1991) ومقرر مجلس الإدارة رقم 7.

The Panel, therefore, finds that Iran has failed to meet the evidentiary requirements for compensation specified in article 35(3) of the Rules and Governing Council decision 46.
82- وعليه، يخلص الفريق إلى أن إيران لم تـف بشروط الإثبات لكـي تحصل على تعويض بموجب المادة 35(3) من القواعد ومقرر مجلس الإدارة رقم 46.

The Claimants maintain that the methodologies adopted by them in estimating damage suffered by them or the compensation claimed for such damage are fully in accordance with Security Council resolution 687 (1991) and Governing Council decision 7 and are not inconsistent with any rules or principles of international law.
78- ويؤكد أصحاب المطالبات أن المنهجيات التي اعتمدوها في تقدير الأضرار التي عانوا منها أو في تقدير التعويض المطالب به عن هذه الأضرار تتفق تماماً مع قرار مجلس الأمن 687(1991) ومقرر مجلس الإدارة 7 وأنها لا تتعارض مع أيٍ من قواعد أو مبادئ القانون الدولي.

The Panel, therefore, finds that the damage is a direct result of Iraq's invasion and occupation of Kuwait in accordance with paragraph 16 of Security Council resolution 687 (1991) and Governing Council decision 7.
وعليه، يرى الفريق أن هذا الضرر هو نتيجة مباشرة لغزو العراق للكويت واحتلاله لها وفقاً للفقرة 16 من قرار مجلس الأمن 687(1991) ومقرر مجلس الإدارة رقم 7.

Accordingly, the costs incurred by Iran are expenses directly resulting from Iraq's invasion and occupation of Kuwait in accordance with paragraph 16 of Security Council resolution 687 (1991) and Governing Council decision 7.
وعليه، فإن التكاليف التي تحملتها إيران هي نفقات ناتجة مباشرة عن غزو العراق للكويت واحتلاله لها وفقاً للفقرة 16 من قرار مجلس الأمن 687(1991) ومقرر مجلس الإدارة رقم 7.

According to Saudi Arabia, Governing Council decision 19 " implemented a narrowly focused policy against requiring Iraq to pay for the military costs of the Allied Coalition Forces " , and must be read together and interpreted in harmony with Security Council resolution 687 (1991) and Governing Council decision 7.
وترى العربية السعودية أن مقرر مجلس الإدارة رقم 19 " طبق سياسة ذات تركيز ضيق ضد مطالبة العراق بدفع التكاليف العسكرية لقوات التحالف " ، وينبغي أن يقرأ ويفسر بما ينسجم مع قرار مجلس الأمن رقم 687(1991) ومقرر مجلس الإدارة رقم 7.

(c) Does " environmental damage and the depletion of natural resources " under Security Council resolution 687 (1991) and Governing Council decision 7 include loss or damage to elements such as cultural property, human health, aesthetic values of landscapes, etc.?
(ج) هل يشمل " الضرر البيئي واستنفاد الموارد الطبيعية " في ظل قرار مجلس الأمن 687 (1991) ومقرر مجلس الإدارة 7(1) الخسائر أو الأضرار التي تصيب عناصر من قبيل الممتلكات الثقافية والصحة البشرية والقيم الجمالية للمناظر الطبيعية، وما إلى ذلك؟

In the view of the Panel, expenses resulting from assistance rendered to countries in the Persian Gulf region to respond to environmental damage, or threat of damage to the environment or public health, qualify for compensation pursuant to Security Council resolution 687 (1991) and Governing Council decision 7.
34- ويرى الفريق أن النفقات الناجمة عن المساعدة المقدمة إلى بلدان من منطقة الخليج للتصدي للأضرار البيئية أو خطر تعرض البيئة أو الصحة العامة لأضرار بيئية، مؤهلة للتعويض عملا بقرار مجلس الإدارة 687 (1991) ومقرر مجلس الإدارة 7.

For their part, the Claimants contend that temporary loss of the use of natural resources, such as the loss of biomass in the marine environment or the presence for long periods of oil contamination on beaches, clearly represents " environmental damage " within the language and meaning of Security Council resolution 687 (1991) and Governing Council decision 7.
48- ويحتج أصحاب المطالبات، من ناحيتهم، بأن الفقدان المؤقت لاستعمال موارد طبيعية، مثل فقدان الكتلة الأحيائية في البيئة البحرية أو وجود تلوث نفطي لفترات طويلة على الشواطئ، يمثل بوضوح " ضرراً بيئياً " باللغة والمعنى المستخدمين في قرار مجلس الأمن 687(1991) ومقرر مجلس الإدارة 7.

As the Panel stated in the fourth " F4 " report, part one, Security Council resolution 687 (1991) and Governing Council decision 7 establish the general principle that Iraq is liable for all damage and losses that result directly from its invasion and occupation of Kuwait.
وكما ذكر الفريق في تقرير الجزء الأول من الدفعة الرابعة من مطالبات الفئة " واو-4 " ، فإن قرار مجلس الأمن 687(1991) ومقرر مجلس الإدارة 7 يقرران مبدأً عاماً هو أن العراق مسؤول عن جميع الأضرار والخسائر التي تنشأ مباشرة عن غزوه للكويت واحتلاله لها.

The Panel, therefore, finds that a loss due to depletion of or damage to natural resources, including resources that may not have a commercial value is, in principle, compensable in accordance with Security Council resolution 687 (1991) and Governing Council decision 7 if such loss was a direct result of Iraq's invasion and occupation of Kuwait.
57- ولذلك يرى الفريق أن حدوث خسارة بسبب استنفاد موارد طبيعية أو وقوع ضرر لها، بما في ذلك الموارد التي قد لا تكون لها قيمة تجارية، هي من حيث المبدأ خسارة قابلة للتعويض وفقاً لقرار مجلس الأمن 687(1991) ومقرر مجلس الإدارة 7 إذا كانت هذه الخسارة قد حدثت كنتيجة مباشرة لغزو العراق للكويت واحتلاله لها.

The Panel has previously stated that Iraq's liability for environmental damage under Security Council resolution 687 (1991) and Governing Council decision 7 is comprehensive and extends to all damage and losses related to the environment and any consequences of such damage that can reasonably be attributed directly to Iraq's invasion and occupation of Kuwait.
67- وقد سبق للفريق أن ذكر أن مسؤولية العراق عن الأضرار البيئية بموجب قرار مجلس الأمن 687(1991) ومقرر مجلس الإدارة 7 هي مسؤولية شاملة وتمتد إلى جميع الأضرار والخسائر المتصلة بالبيئة وأي آثار لهذه الأضرار يمكن عزوها مباشرة على نحو معقول إلى غزو العراق للكويت واحتلالـه لـها.

The Panel, therefore, finds that increases in the incidence of low birth-weight infants and malnourished children in Jordan were not a direct result of Iraq's invasion and occupation of Kuwait, in accordance with Security Council resolution 687 (1991) and Governing Council decision 7.
وعليه، يرى الفريق أن الزيادة في عدد الرضّع المنخفضي الوزن عند الولادة والأطفال الذين يعانون من سوء التغذية في الأردن ليسا نتيجة مباشرة لغزو العراق للكويت واحتلاله لها، وفقاً لقرار مجلس الأمن 687(1991) ومقرر مجلس الإدارة رقم 7.
