Article 8 provides for the possibility of diplomatic protection by a State in respect of stateless persons and refugees lawfully and habitually resident in that State.
تنص المادة 8 على أنه بإمكان الدولة أن تقدم الحماية الدبلوماسية للأشخاص عديمي الجنسية واللاجئين الذين يقيمون في هذه الدولة بصفة قانونية واعتيادية.

The view was also expressed that extending diplomatic protection to refugees and stateless persons was undesirable and susceptible to wider interpretation by the State of habitual residence of the stateless person, since the phrase " lawfully and habitually resident " in paragraph 1 referred only to the national law and not to an international standard.

It was also suggested that the phrase " lawfully and habitually resident " be replaced by " lawfully staying " , as per article 28 of the 1951 Convention on the Status of Refugees.
