Having declared the detention of Mohamed Nasheed and Mohamed Shafeeq to be arbitrary, the Working Group requests the Government of the Republic of Maldives to take the necessary measures to remedy the situation in order to bring it into conformity with the provisions and principles incorporated in the Universal Declaration of Human Rights and in the International Covenant on Civil and Political Rights.

Consequent upon the decision of the Working Group declaring the detention of Yang Kyu-hun to be arbitrary, the Working Group requests the Government of the Republic of Korea to take the necessary steps to remedy the situation in order to bring it into conformity with the provisions and principles incorporated in the Universal Declaration of Human Rights and in the International Covenant on Civil and Political Rights.

That requirement has not been met in the present case, as Mr. Anwar was not promptly informed about the charge against him and brought before a judge, contrary to the rights provided for in the Emergency Decree of 2005 and in the International Covenant on Civil and Political Rights.
ولم يتم الوفاء بهذا الشرط في الحالة الراهنة، لأن السيد أنور لم يُعلم فوراً بالتهمة الموجهة إليه ولم يُحضر أمام قاضٍ، خلافاً للحقوق المنصوص عليها في مرسوم الطوارئ لعام 2005 والعهد الدولي الخاص بالحقوق المدنية والسياسية.

Suspects must be informed of the charges against them and the rights available to them; and full access to a lawyer must be guaranteed in order to ensure an adequate defence, in addition to the safeguards enshrined in article 20 of the Constitution and in the International Covenant on Civil and Political Rights.
وينبغي إطلاع المتهم على الأفعال المنسوبة إليه والحقوق الخاصة به، فضلاً عن ضرورة كفالة وصوله بالكامل إلى خدمات محام يكفل له دفاعاً وافياً، في جملة ضمانات منصوص عليها في المادة 20 من الدستور والعهد الدولي الخاص بالحقوق المدنية والسياسية.
