7.3 The Committee notes that the author alleges that his two brothers, Idriss and Juma Aboufaied, were subjected by the Libyan authorities to enforced disappearance.
7-3 وتلاحظ اللجنة أن صاحب البلاغ يدعي أن السلطات الليبية عرّضت شقيقيه، إدريس وجمعة أبو فايد للاختفاء القسري.

7.5 With regard to the author, the Committee notes the anguish and distress caused by the successive disappearance of his two brothers Idriss and Juma Aboufaied.
7-5 وفيما يتعلق بصاحب البلاغ، تلاحظ اللجنة ما أصابه من ألم وأسى جراء توالي اختفاء شقيقيه إدريس وجمعة أبو فايد.

The Committee, therefore, finds that the enforced disappearance of Idriss and Juma Aboufaied deprived them of the protection of the law during that period, in violation of article 16 of the Covenant.
ومن ثم ترى اللجنة أن الاختفاء القسري لإدريس وجمعة أبو فايد قد حرمهما من حماية القانون خلال تلك الفترة، في انتهاك للمادة 16 من العهد.

In my opinion, therefore, the Committee should have concluded in its Views that a violation of article 6, paragraph 1, was committed in respect of the brothers Idriss and Juma Aboufaied.
وعليه، فإنني أرى أنه كان يتعين على اللجنة أن تخلص في آرائها إلى حدوث انتهاك للفقرة 1 من المادة 6 فيما يتعلق بالشقيقين إدريس وجمعة أبو فايد.

3.1 The author claims that Idriss and Juma Aboufaied were both subjected to enforced disappearance by the Libyan authorities, albeit during different periods.
3-1 يدعي صاحب البلاغ أن السلطات الليبية عرضت كلاً من إدريس وجمعة أبو فايد للاختفاء القسري، وإن كان ذلك قد تم خلال فترات مختلفة.

7.2 Regarding the alleged secret and incommunicado detention of Idriss and Juma Aboufaied, the Committee recognizes the degree of suffering involved in being held indefinitely without contact with the outside world.
7-2 وفيما يتعلق بادعاء احتجاز إدريس وجمعة أبو فايد في مكان مجهول وبمعزل عن العالم الخارجي، تسلّم اللجنة بدرجة المعاناة الناجمة عن الاحتجاز لفترة غير محددة وبمعزل عن العالم الخارجي.

In the present case, the State party authorities subjected Idriss and Juma Aboufaied to incommunicado detention and refused to provide the family with any information concerning their whereabouts or condition, and further intimidated the family from seeking redress or assistance for them.
وفي القضية قيد النظر، أخضعت سلطات الدولة الطرف إدريس وجمعة أبو فايد للاحتجاز بمعزل عن العالم الخارجي ورفضت تزويد الأسرة بأي معلومات تتعلق بأماكن وجودهما أو بظروفهما، بل وهددتها إذا التمست الانتصاف أو المساعدة من أجلهما.
