Mention was made of examples of subsequent practice in the interpretation and application of common article 3 of the 1949 Geneva Conventions relating to international humanitarian law and of Additional Protocol II to those conventions, with respect to the criminalization of violations of international humanitarian law in the context of non-international armed conflicts.

4. Serious violations of article 3 common to the Geneva Conventions of 1949 and of Additional Protocol II, are the only crime within the statute for the Rwanda Tribunal which is inextricably linked to the existence of an armed conflict, since the Geneva Conventions only apply in time of war.
٤ - الانتهاكات الجسيمــة للمــادة ٣ المشتركــة بين اتفاقيات جنيــف الموقعـة عام ١٩٤٩ وللبروتوكول اﻹضافي الثاني، وهي الجريمة الوحيدة من الجرائم المبينة في النظام اﻷساسي للمحكمة الجنائية الدولية لرواندا التي تتصل اتصالا لا تنفصم عراه بوجود نزاع مسلح، ﻷن اتفاقيات جنيف لا تنطبق إلا على وقت الحرب.

22. The Belgian law had therefore brought in a practice later followed by States and by jurisprudence establishing the criminal consequences of violations of article 3 common to the Geneva Conventions and of Additional Protocol II thereto.

In respect of Anatole Nsengiyumva, the Appeals Chamber affirmed his convictions for genocide, crimes against humanity (extermination and persecution), and serious violations of article 3 common to the Geneva Conventions and of Additional Protocol II (violence to life) in relation to certain killings.

The Court also has jurisdiction in regard to violations of article 3 common to the Geneva Conventions of 1949 and of Additional Protocol II. Article 5 gives the Special Court jurisdiction over crimes under Sierra Leonean law, including offences relating to the abuse of girls under the Prevention of Cruelty to Children Act of 1926.

7. The Nordic countries and Poland, in their responses, agreed that there was a need to address any lack of protection of persons in situations of internal violence, which fell outside the scope of common article 3 of the four Geneva Conventions and of Additional Protocol II thereto, and when effective implementation of human rights might be limited by derogations in exceptional circumstances.

1. The Tribunal is competent to prosecute persons responsible for having committed one or more of the following three crimes: genocide (article 2, paragraph 2); crimes against humanity (article 3); and violations of article 3 common to the Geneva Conventions and of Additional Protocol II (article 4).
١ - المحكمة مختصة بمحاكمة اﻷشخاص المسؤولين عن ارتكاب جريمة أو أكثر من الجرائم الثلاث التالية: اﻹبادة الجماعية )المادة ٢، الفقرة ٢(؛ الجرائم المرتكبة في حق اﻹنسانية )المادة ٣(؛ الانتهاكات للمادة ٣ المشتركة بين اتفاقيات جنيف وللبروتوكول اﻹضافي الثاني )المادة ٤(.

46. During the period under review, the following nine accused persons have been arrested and transferred to the Tribunal's Detention Facility in Arusha where they are awaiting trial on charges including genocide, conspiracy to commit genocide, direct and public incitement to commit genocide, crimes against humanity and violations of article 3 common to the Geneva Conventions and of Additional Protocol II thereto:

23. The second example of such subsequent practice with respect to the application and interpretation of article 3 common to the Geneva Conventions and of Additional Protocol II thereto was illustrated in the amendment proposed by Belgium to article 8 of the Rome Statute of the International Criminal Court.
23 - وأضاف أن المثال الثاني للممارسة اللاحقة من هذا القبيل فيما يتعلق بتطبيق وتفسير المادة 3 المشتركة بين اتفاقيات جنيف وبروتوكولها الإضافي الثاني تتضح في التعديل الذي اقترحته بلجيكا على المادة 8 من نظام روما الأساسي للمحكمة الجنائية الدولية.

21. Mr. Duray (Belgium) said that, in response to the request for information relating to treaties over time contained in paragraph 27 of the Commission's report, his delegation wished to provide two relevant examples of subsequent practice with respect to the application and interpretation of article 3 common to the Geneva Conventions and of Additional Protocol II thereto.

War crimes should be included, being grave violations of the Geneva Conventions and of Additional Protocol I. However, internal conflicts should be excluded, provided that a State was correctly meeting its obligations.
٨٨ - وينبغي ادراج جرائم الحرب ، حيث انها انتهاكات جسيمة لاتفاقيات جنيف والبروتوكول الاضافي اﻷول . بيد أن المنازعات الداخلية ينبغي استبعادها ، شريطة أن تفي الدولة بالتزاماتها على نحو صحيح .
