بيان القاضي هيرتشيغ تنص المادة ٩ من النظام اﻷساسي لمحكمة العدل الدولية على أنه " ينبغي أن يكون تشكيل الهيئة في جملتها كفيلا بتمثيل الحضارات الكبرى والنظم القانونية الرئيسية في العالم " .

وأود أن أذكّر الأعضاء بأن أحكام النظام الأساسي للجنة القانون الدولي تنص على أن تتألف اللجنة من أشخاص معترف بكفاءتهم في مجال القانون الدولي؛ وعلى أن يتمتع كل شخص من الأشخاص المقرر انتخابهم لعضوية اللجنة بالمؤهلات اللازمة؛ وأن يكفل في تشكيل اللجنة ككل تمثيل الأشكال الرئيسية المختلفة للحضارة والنظم القانونية الأساسية في العالم.
