مبادئ التعاون الدولي في تعقب واعتقال وتسليم ومعاقبة اﻷشخاص المذنبين بارتكاب جرائم حرب وجرائم ضد اﻹنسانية ٣ كانون اﻷول/ديسمبر ١٩٧٣

(b) To recommend modalities for the trial and punishment of persons identified by the commission as being responsible for offences investigated by it;
)ب( التوصية بطرائق محاكمة ومعاقبة اﻷشخاص الذين تحددهم اللجنة بأنهم مسؤولون عن الجرائم التي حققت فيها؛

V). The Principles of international cooperation in the detection, arrest, extradition and punishment of persons guilty of war crimes and crimes against humanity take the approach that every State has the right to try its own nationals for war crimes against humanity (Princ. 2).
وتنص مبادئ التعاون الدولي في تَعَقﱡب واعتقال وتسليم ومعاقبة اﻷشخاص المذنبين بارتكاب جرائم حرب وجرائم ضد اﻹنسانية على أن لكل دولة الحق في محاكمة مواطنيها بسبب جرائم حرب مرتكبة ضد اﻹنسانية )المبدأ ٢(.

On 3 December 1973, the General Assembly adopted resolution 3074 (XXVIII) entitled “Principles of international cooperation in the detection, arrest, extradition and punishment of persons guilty of war crimes and crimes against humanity”.
وفي ٣ كانون اﻷول/ديسمبر ٣٧٩١، اعتمدت الجمعية العامة القرار ٤٧٠٣ )د-٨٢( بعنوان " مبادئ القانون الدولي في تعقب واعتقال وتسليم ومعاقبة اﻷشخاص المذنبين بارتكاب جرائم حرب وجرائم ضد اﻹنسانية " .

وإذ تشير إلى قرار الجمعية العامة ٣٠٧٤ )د-٢٨( المؤرخ في ٣ كانون اﻷول/ديسمبر ١٩٧٣ والمعنون: " مبادئ التعاون الدولي في اكتشاف واعتقال وتسليم ومعاقبة اﻷشخاص المذنبين في جرائم الحرب والجرائم المرتكبة ضد اﻹنسانية " ،

VIII). Further, pursuant to the Principles of international cooperation in the detection, arrest, extradition and punishment of persons guilty of war crimes and crimes against humanity, States shall cooperate with each other on a bilateral and multilateral basis with a view to halting and preventing war crimes and crimes against humanity, and shall take the domestic and international measures necessary for that purpose (Princ. 3).
وعلاوة على ذلك، فعملاً بمبادئ التعاون الدولي في تعقب واعتقال وتسليم ومعاقبة اﻷشخاص المذنبين بارتكاب جرائم حرب وجرائم ضد اﻹنسانية، تتعاون الدول بعضها مع بعض، على أساس ثنائي ومتعدد اﻷطراف، بغية وقف جرائم الحرب والجرائم ضد اﻹنسانية والحيلولة دون وقوعها، وتتخذ على الصعيدين، الداخلي والدولي، التدابير اللازمة لهذا الغرض )المبدأ ٣(.
