18. Terrorism is not a new phenomenon. It has been on the international agenda since 1934, when the League of Nations took the first major step towards outlawing this scourge by discussing a draft convention for the prevention and Punishment of Terrorism.

40. In conjunction with the adoption of the Convention for the Prevention and Punishment of Terrorism, it was envisaged that an international criminal court be established for the purpose of trying persons accused of offences under the Convention.

It is suggested that commissions and working and study groups for the prevention and Punishment of Terrorism should be recommended to include mercenary activities in their analyses and conclusions”.
ويرى المقرر الخاص توصية اللجان والأفرقة العاملة والأفرقة الدراسية المعنية بمنع الإرهاب والمعاقبة عليه بتناول أنشطة المرتزقة في تحاليلها واستنتاجاتها " .

The said Court was intended to be established for the trial of persons accused of an offence dealt with in the Convention for the Prevention and Punishment of Terrorism from the same date.
وكان الغرض من تلك المحكمة التي أريد إنشاؤها محاكمة الأشخاص المتهمين بارتكاب فعلٍ تتناوله اتفاقية منع الإرهاب والمعاقبة عليه اعتباراً من ذلك التاريخ نفسه().

However, the Convention for the Prevention and Punishment of Terrorism has introduced yet another condition which significantly limits its application, namely an element of jurisdictional reciprocity.
إلا أن اتفاقية منع الإرهاب والمعاقبة عليه استحدثت كذلك شرطا آخر يحد بقدر كبير من تطبيقها، وهو عنصر المعاملة بالمثل فيما يخص الولاية القضائية().

The Convention for the Prevention and Punishment of Terrorism subjects the obligation to grant extradition to " any conditions and limitations recognized by the law or practice of the country to which the application is made " .
وترهن اتفاقية منع الإرهاب والمعاقبة عليه الالتزام بالموافقة على التسليم بـ " أي شروط وقيود يقرها القانون أو الممارسة في البلد الموجه إليه الطلب " ().

(d) The Convention for the Prevention and Punishment of Terrorism contains an additional paragraph extending the extradition regime to include any offence committed in the territory of the party against whom it is directed.
(د) تضم اتفاقية منع الإرهاب والمعاقبة عليه فقرة إضافية توسع من نطاق نظام التسليم ليشمل أي جريمة ارتُكبت في إقليم الدولة الطرف المستهدفة بالجريمة().

Consequently, a Convention for the Creation of an International Criminal Court was concluded together with the Convention for the Prevention and Punishment of Terrorism and thus provided States parties with a so-called " third option " in relation to its mechanism for the punishment of offenders.
وبناء على ذلك، أُبرمت اتفاقية إنشاء محكمة جنائية دولية() إلى جانب اتفاقية منع الإرهاب والمعاقبة عليه، ومن ثم زودت الدول الأطراف بما يسمى " الخيار الثالث " فيما يتعلق بآليتها لمعاقبة الجناة.

The Convention further specified that States parties to the Convention for the Prevention and Punishment of Terrorism that took advantage of this option were deemed to have discharged their obligations thereunder.

36. Regarding the provisions on foreigners who have committed an offence in a third State, both the Convention for the Suppression of the Illicit Traffic in Dangerous Drugs and the Convention for the Prevention and Punishment of Terrorism have adopted very similar language to that found in article 9 of the Counterfeiting Convention.
36 - وفيما يتعلق بالأحكام الخاصة بالأجانب الذين يرتكبون جريمة في بلد ثالث، اعتمدت اتفاقية قمع الاتجار غير المشروع بالمخدرات الخطرة واتفاقية منع الإرهاب والمعاقبة عليه على السواء صياغة مماثلة إلى حد كبير لصياغة المادة 9 من اتفاقية مكافحة التزييف().

(c) The Convention for the Prevention and Punishment of Terrorism and the Convention for the Suppression of the Traffic in Persons have omitted a reference to States making extradition conditional on " reciprocity " , but refer to those States that condition extradition on the existence of a treaty;

Pursuant to this third option, States parties had the alternative of committing a person (national or foreigner) accused of an offence under the Convention for the Prevention and Punishment of Terrorism for trial to the Court instead of prosecuting before its own courts.
ووفقا لذلك الخيار الثالث، يكون أمام الدول الأطراف البديل المتمثل في تقديم الشخص (المواطن أو الأجنبي) المتهم بارتكاب جريمة بموجب اتفاقية منع الإرهاب والمعاقبة عليه للمحاكمة أمام المحكمة الجنائية عوضا عن محاكمته أمام محاكم تلك الدول.

The National Assembly has included in its legislative programme the revision of our penal code as regards the definition and Punishment of Terrorism. In November 2007, the Prime Minister of Viet Nam adopted a directive document setting up a governmental mechanism to coordinate the counter-terrorism policies of all ministries and branches. That mechanism reports directly to the Prime Minister.
وقد ضمنت الجمعية الوطنية في برنامجها التشريعي مراجعة مجموعة القوانين الجزائية فيما يتعلق بتعريف جريمة الإرهاب والمعاقبة عليها ففي تشرين الثاني/نوفمبر 2007، اعتمد رئيس الوزراء وثيقة توجيهية تُنشئ آلية حكومية لتنسيق سياسات مكافحة الإرهاب في جميع الوزارات وفروع أجهزة الدولة وتأتمر تلك الآلية بأمر رئيس الوزراء مباشرة.
